PART I

PRELIMINARY

Citation

1.  These Regulations may be cited as the Telecommunications (Cable Detection Workers) Regulations.

Definitions

2.  In these Regulations, unless the context otherwise requires —

“licence” means a licence granted by the Authority permitting a person to perform such telecommunication cable detection work as is specified in the licence;

“licensee” means the holder of a valid licence;

“register” means the register of licensees maintained under regulation 6.

PART II

APPLICATION FOR AND GRANT OF LICENCE

Application for licence

3.  An application for a licence shall be made to the Authority in such form as the Authority may determine and shall be accompanied by the appropriate fee specified in the Schedule.

Qualifications

4.—(1)  No licence shall be granted to any person unless the Authority is satisfied that —

(a) he holds an Industrial Technician Certificate, or a National Technical Certificate Grade 2, issued by the Institute of Technical Education, Singapore, has not less than 3 GCE ‘O’ level passes or holds such other educational qualifications as may be acceptable to the Authority;

(b) he has not less than one year’s relevant practical experience in building construction, building services, civil engineering or structural engineering construction or such other relevant experience for such duration as may be acceptable to the Authority; and

(c) he has successfully completed a course in telecommunication cable detection work approved by the Authority.

(2)  The Authority may refuse to grant a licence to any person whose licence has previously been cancelled.

Licence to be signed by authorised officer, etc.

5.  A licence shall —

(a) be signed by an officer authorised by the Authority;

(b) remain valid unless cancelled or suspended in accordance with the provisions of the Act or these Regulations; and

(c) be subject to such terms and conditions as the Authority may, from time to time, determine.

PART III

REGISTER OF LICENSEES

Register

6.  The Authority shall maintain a register of licensed telecommunication cable detection workers which shall, in respect of each licensee, contain the following particulars:

(a) the full name and address of the licensee as provided by the licensee;

(b) the date on which the licence was granted;

(c) the registration number of the licence;

(d) whether the licensee has been convicted of any offence under the Act;

(e) whether the licence has been suspended or cancelled; and

(f) such other particulars as the Authority thinks fit.

Inspection of register

7.—(1)  Any person may, upon payment of the appropriate fee specified in the Schedule, inspect the register during the office hours of the Authority.

(2)  The Authority may provide a certified true copy of an entry in the register to any person on payment of the appropriate fee specified in the Schedule.

PART IV

DUTIES OF LICENSED TELECOMMUNICATION CABLE DETECTION WORKERS

Duties of licensee

8.—(1)  Every licensee shall —

(a) carry out any telecommunication cable detection work that he is permitted to carry out under his licence in accordance with the conditions of his licence and the provisions of the Act and these Regulations;

(b) on being required by the Authority or a telecommunication system licensee or any person authorised by the Authority or the telecommunication system licensee for this purpose, produce his licence for examination and furnish such information required by it relating to his performance of any telecommunication cable detection work;

(c) if he knows or ought reasonably to know of any damage to any telecommunication cable belonging to, or under the management or control of, a telecommunication system licensee, immediately inform the telecommunication system licensee of the damage by the quickest practicable means;

(d) immediately inform the Authority in writing of any change in his address; and

(e) attend at such place as the Authority, or any person authorised by the Authority, may specify to produce such documents or furnish such information as the Authority or that person may require for the purpose of ensuring compliance with the provisions of the Act and these Regulations.

(2)  It shall be a condition of every licence that the licensee shall carry out his duties as a telecommunication cable detection worker in a safe, careful and proper manner.

(3)  A licensee shall not cause any telecommunication cable detection work to be carried out by any person, whether employed by him or otherwise, who is not a licensee.

Tests and examinations

9.  For the purpose of ensuring that a licensee is competent to carry out telecommunication cable detection work, the Authority may, at any time by notice in writing, require the licensee to attend at such time and place specified in the notice to take and successfully complete such tests or examinations as the Authority may require.

PART V

CANCELLATION AND SUSPENSION OF LICENCE

Cancellation, suspension, etc., of licence

10.—(1)  In addition to any penalty which may be imposed under these Regulations or otherwise, if a licensee —

(a) has, in the opinion of the Authority, obtained his licence by making or causing to be made or produced any false or fraudulent declaration, certificate, or representation, in writing or otherwise;

(b) has been convicted of any offence under the Act or any regulations made thereunder, or of any other offence which is of such a nature as to render it, in the opinion of the Authority, undesirable that he should continue to hold such licence;

(c) contravenes any term or condition of his licence;

(d) having been given notice under regulation 9 to attend at a specified time and place to take a test or an examination as required by the Authority, fails to attend at that time or place or fails the test or examination;

(e) is, in the opinion of the Authority, for any reason incapable of carrying out the cable detection work in respect of which the licence was granted;

(f) applies to have his licence cancelled or suspended; or

(g) is, in the opinion of the Authority, for any other reason, unfit to hold or to continue to hold a licence,

the Authority may cancel or suspend the licence for such period as the Authority thinks fit.

(2)  Where a licence is cancelled or suspended, no fee or part thereof shall be refunded by the Authority to the licensee in respect of the unexpired period of the licence.

(3)  Where the Authority is satisfied in any case that a licensee has failed to comply with the condition referred to in regulation 8(2), the Authority may, without prejudice to any other action that it is entitled to take under the Act or these Regulations, order the licensee to undergo such retraining as the Authority may specify for a period not exceeding 12 months.

Reduction of period of suspension

11.  The Authority may, at any time and for such reason as it thinks sufficient, reduce the period for which a licence has been suspended.

Return of suspended or cancelled licence

12.  If any licence is suspended or cancelled, the licensee shall, within 14 days of the date of suspension or cancellation, deliver the licence and any duplicate or replacement licence to the Authority.

PART VI

GENERAL

Replacement licence

13.  If the Authority is satisfied that any licence has been lost, destroyed or defaced, the Authority may, upon payment of the appropriate fee specified in the Schedule, grant a replacement licence.

Penalties

14.  Without prejudice to the right of the Authority to exercise its powers under regulation 10, any licensee who —

(a) contravenes regulation 8(1)(b), (c), (d) or (e) or (3); or

(b) fails to deliver any licence to the Authority as required under regulation 12,

shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.
