1.—(1) The ship provides voyages that meet all of the following requirements:| (a) | the voyages are for leisure travel for any person against payment; | | (b) | any part of each voyage is on the high seas; | | (c) | the voyages are undertaken on a regular basis on any particular route or routes, in accordance with timetables and sailing dates advertised in advance and made available by the cruise line of the ship; | | (d) | as at 1 January of a year, 70% or more of the planned voyages for that year are for at least 24 hours in length. |
(2) For the purpose of sub‑paragraph (1)(d) —| (a) | the percentage of planned voyages of a ship in a year is to be determined based on its planned voyages that are to commence in that year (including any that is to conclude in another year); and | | (b) | the length of any voyage that is to commence in that year but is to conclude in another year, is the entire length of the voyage from the time of commencement until the time of conclusion. |
