3.—(1) Subject to sub‑paragraph (2), sections 8 and 9 of the Act do not apply to the LTA in relation to providing a service using motorised personal mobility devices or power‑assisted bicycles, or a combination of such vehicles, under which an employee or outworker of the LTA can —| (a) | hire a docked motorised personal mobility device or docked power‑assisted bicycle to ride on wholly or partly in a public place; and | | (b) | end the hiring of the motorised personal mobility device or power‑assisted bicycle by docking it in or at the premises of the LTA, |
| for the purpose of performing employment duties, or work contracted to be performed under an outwork arrangement for the LTA. |
(2) The exemption in sub‑paragraph (1) is subject to the following conditions:| (a) | there is in force, at any time the motorised personal mobility device or power‑assisted bicycle is used, a policy of insurance in relation to the motorised personal mobility device or power‑assisted bicycle insuring against any liability in respect of —| (i) | the death of or bodily injury sustained by any person (other than the rider or any passenger of the motorised personal mobility device or power‑assisted bicycle); and | | (ii) | any property damage suffered by any person (other than the rider or any passenger of the motorised personal mobility device or power‑assisted bicycle), |
| caused by or arising out of the use of the motorised personal mobility device or power‑assisted bicycle; |
| | (b) | the risk under the policy of insurance mentioned in sub‑paragraph (a) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore. |
