Road Traffic (Exemption from
Requirement for Instructor’s Licence)
Order 2016
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Road Traffic (Exemption from Requirement for Instructor’s Licence) Order 2016 and comes into operation on 1 January 2017.
Exemption
2.  Every person who is employed as a driving instructor by a holder of a driving school licence specified in the First Schedule, and who satisfies the conditions in the Second Schedule, is exempted from section 51(1) of the Act while he or she remains so employed.

SECOND SCHEDULE
Paragraph 2
Conditions
1.  The driving instructor is below the age of 75 years.
2.  The driving instructor has undergone the driving instructor’s training programme conducted by the holder of the driving school licence by which the driving instructor is employed, and has passed a driving instructor’s certification test conducted by the Traffic Police.
3.  The driving instructor —
(a)within 2 months before attaining the age of 70, 71, 72, 73 or 74 years (each called an applicable age), undergoes a medical examination mentioned in section 35(10A)(a) of the Act at the driving instructor’s own expense; and
(b)submits to the driving school, no later than the date before the driving instructor attains an applicable age, a certification by the registered medical practitioner who conducted the medical examination that the driving instructor is physically fit to drive a vehicle of the class for which the driving instructor is to conduct any driving lesson or training.
