(Exemption) (No. 2)
Order 2017
In exercise of the powers conferred by section 40 of the Remote Gambling Act 2014, the Minister for Home Affairs makes the following Order:
Citation
1.  This Order is the Remote Gambling (Exemption) (No. 2) Order 2017.
Definitions
2.  In this Order, unless the context otherwise requires —
“draw” means the draw to be held at 5 p.m. on 25 October 2017 at 40 Scotts Road, Environment Building, Singapore 228231, as part of the promotion;
“organiser” means the National Environment Agency established under section 3 of the National Environment Agency Act (Cap. 195);
“promotion” means the promotion called “Energy‑Saving Challenge” which is to be made available from 15 June 2017 to 30 September 2017 (both dates inclusive) on the website at http://cgs.sg/esc;
“public accountant” has the same meaning as in section 2(1) of the Accountants Act (Cap. 2).
Exemption
3.—(1)  The organiser is exempt from sections 11, 13, 15 and 17 of the Act in respect of the promotion and the draw.
(2)  The exemption is subject to compliance by the organiser with the conditions specified in the Schedule.
THE SCHEDULE
Paragraph 3(2)
Conditions
1.All the following details must be included in publicity material that must be freely accessible to every participant of the draw:
(a)the name and address of the organiser;
(b)the details of the prizes to be distributed;
(c)the manner in which the prizes will be distributed;
(d)the time, date and place of the draw;
(e)how a person may participate in the draw;
(f)the manner in which the draw is to be conducted.
2.The organiser must keep a record of the name and email address of every participant of the draw.
3.Only persons in the employment of the organiser may conduct the draw.
4.The draw must —
(a)be conducted in public; or
(b)if conducted in private by means of a computerised system, be witnessed and audited by a public accountant who is not in the employment of the organiser.
5.The organiser must undertake to ensure that —
(a)every winner is notified by telephone or in writing by electronic means; and
(b)the results of the draw are published on the website at http://cgs.sg/esc.
6.The organiser must, before the start of the draw, undertake to ensure that an audited statement of accounts and the results of the draw are sent by registered post to the Head, Specialised Crime Policy Branch, Criminal Investigation Department, no later than 26 January 2018.
