Citation

1.  This Notification may be cited as the Parks and Trees (Planting Areas) Notification.

Application

2.  This Notification shall apply to —

(a) any premises referred to in section 22 of the Act; and

(b) any premises in respect of which an application for planning permission is made on or after 1st August 2005,

being premises which comprise an open air parking area at street level.

Planting areas for premises with open air parking area

3.  All premises referred to in paragraph 2 shall have the following planting areas:

(a) where the parking area does not adjoin or abut any other planting area, green verge or any building within the premises, a planting area of not less than 2 metres wide along the length of the parking area;

(b) where the parking area has 2 or more parallel rows of parking lots, a planting area of not less than 4 metres wide in the centre divider separating the parallel rows of parking lots; and

(c) where the parking area is adjacent to any building within the premises, a planting area of not less than 4 metres wide between the parking area and the building.
