Port of Singapore Authority (Scale of Charges) Notification 1997
In exercise of the powers conferred by section 58(1) of the Port of Singapore Authority Act, the Port of Singapore Authority, with the approval of the Minister for Communications, hereby makes the following Notification:
Citation and commencement
1.  This Notification may be cited as the Port of Singapore Authority (Scale of Charges) Notification 1997 and shall come into operation on 9th April 1997.
Definitions
2.  In this Notification, unless the context otherwise requires —
“container” means a freight container complying with all relevant prevailing standards set by the International Organisation for Standardization (ISO) and which can be conveyed by one or more modes without intermediate reloading and fitted with devices permitting ready handling and with unique identification numbers and markings;
“dangerous goods” means any Group I or Group II dangerous goods specified in the Maritime and Port Authority of Singapore (Dangerous Goods, Petroleum and Explosives) Regulations 1997 (G.N. No. S 182/97);
“FCL container” means a container which fulfils the conditions as may be set out by the PSA from time to time in a PSA terminal circular for the grant of FCL container status for the purposes of this Notification;
“GT” means the gross tonnage of a vessel measured in accordance with the method set out in the International Convention of Tonnage Measurement of Ships as amended from time to time;
“half shift” means one of the following periods:
(a)0700 hours to 1100 hours;
(b)1200 hours to 1500 hours;
(c)1500 hours to 1830 hours;
(d)1930 hours to 2300 hours;
(e)2300 hours to 0200 hours; or
(f)0200 hours to 0600 hours;
“LOA” means the length of a vessel measured from the extreme point forward of the vessel to the extreme point aft of the vessel;
“nearest hour” means one hour but not any fraction exceeding that hour unless such fraction exceeds one-half hour in which case such fraction exceeding one-half hour shall be regarded as another hour;
“nearest tonne” means one tonne but not any fraction exceeding that tonne unless such fraction exceeds 0.5 tonne, in which case such fraction exceeding 0.5 tonne shall be regarded as another tonne;
“passenger ferry vessel” means a vessel which carries more than 12 passengers;
“passenger vessel” means a vessel —
(a)which has a definite and fixed estimated time of arrival, estimated time of departure and sailing schedules which shall be lodged with the PSA within such time as may be specified by the PSA from time to time in a PSA terminal circular; and
(b)where the number of passengers carried during a voyage when the vessel calls at the port is not less than 100 and these passengers may or may not embark or disembark;
“per annum” or “per year” means a period of 12 months beginning from 1st January in any year;
“per day” means per calendar day;
“pleasure craft” has the same meaning as in the Maritime and Port Authority of Singapore (Pleasure Craft) Regulations 1997 (G.N. No. S 186/97);
“PSA” means the Port of Singapore Authority;
“PSA berth” means any berth owned by the PSA;
“PSA container yard” means any container yard owned by the PSA;
“PSA pipeline” means any pipeline owned by the PSA;
“PSA premises” means any premises owned by the PSA;
“PSA terminal” means any terminal owned by the PSA;
“PSA terminal circular” means a notice given by the PSA to the shipping community of Singapore;
“PSA transit shed” means any transit shed owned by the PSA;
“PSA transit warehouse” means any transit warehouse owned by the PSA;
“PSA warehouse” means any warehouse owned by the PSA;
“PSA wharf” means any wharf owned by the PSA;
“reefer” means any freight container constructed in compliance with the standards set by the International Organisation for Standardization (ISO) for the purpose of the carriage of goods which require refrigeration;
“re-export container” means a container which fulfils such conditions as may be set out by the PSA from time to time in a PSA terminal circular for the grant of re-export containers status for the purposes of this Notification;
“re-export goods” means goods which fulfils such conditions as may be set out by the PSA from time to time in a PSA terminal circular for the grant of re-export goods status for the purposes of this Notification;
“tonne” means one metric tonne or 1,000 kilograms or one cubic metre;
“transhipment container” means a container which fulfils such conditions as may be set out by the PSA from time to time in a PSA terminal circular for the grant of transhipment container status for the purposes of this Notification;
“transhipment goods” means goods which fulfils such conditions as may be set out by the PSA from time to time in a PSA terminal circular for the grant of transhipment goods status for the purposes of this Notification.
Charges and rates
3.—(1)  The charges and the rates payable to the PSA for the use of premises, works or appliances, and for services or facilities provided by the PSA and the persons liable to pay the specified charges and rates and other matters specified in the Schedule shall be as specified in the Schedule.
(2)  Where the Schedule provides that any charge or rate may be payable by more than one person, the PSA may, in its discretion, decide alternatively the person or combination of persons who shall pay the charge or rate.
Tonnage of goods
4.  Whether or not a vessel's manifest or shipping note is lodged with the PSA in accordance with the Singapore Port Regulations (Rg 6), the PSA may elect to calculate all tonnages of goods according to the cubic measurement or gross weight, whichever is the greater.
Rebates and concessions
5.  The rebates and concessions prescribed in the Schedule shall be granted only to a person who has a credit account with the PSA.
Date on which a person ceases to be agent or owner of vessel
6.—(1)  For the purposes of this Notification, a person shall cease to be an agent or owner, as the case may be, of a vessel only —
(a)on the date of receipt by the PSA of a notice in writing from that person that he has ceased to be the agent or owner, as the case may be; or
(b)on the date stipulated by that person in the notice in writing to the PSA as the date he ceases to be the agent or owner, as the case may be,
whichever is the later.
(2)  Notwithstanding sub-paragraph (1), the person referred to in that sub-paragraph shall continue to be liable for any charges or rates payable by him as an agent or owner of a vessel prior to the date he ceases to be an agent or owner, as the case may be, of the vessel under that sub-paragraph.
Application, etc., by electronic means
7.  Notwithstanding this Notification, the PSA may allow any application, request or notice referred to in this Notification to be made or given or transmitted electronically.
Cancellation
8.  The Port of Singapore Authority (Scale of Dues and Rates) Notification (N 9) is cancelled.

Section I

CHARGES FOR MARINE SERVICES — PAYABLE BY THE OWNER OR
AGENT OF A VESSEL, UNLESS OTHERWISE EXPRESSLY PROVIDED

Provided that an oil rig or a vessel of unusual characteristics, including a vessel on tow or a vessel having emergency or special assistance, shall be charged according to the rate set out in sub-paragraph (ix) regardless of it being a vessel of a particular gross tonnage set out in sub-paragraphs (i) to (viii).
(b)less than 4 hours before the services are required
A charge which is 1.5 times the rate specified in sub-paragraph (a).
(2)  Where an order for the services of a PSA pilot is placed less than 4 hours before the services are required, the PSA may refuse to accept the order.
(3)  Where the PSA accepts an order for the services of a PSA pilot for a vessel which is exempted from compulsory pilotage, the fees payable for such services shall be double the rate specified in paragraph (1)(a) or (b), whichever is applicable.
(4)  For the purposes of calculating the fees payable for any professional pilotage services, the period for which such services are payable shall commence from the time the services are required as specified in the order to the time the pilot leaves the vessel.
(5)  The fees specified in this item shall be payable in addition to the fees specified in item 2.
Charges for Cancelling or Amending an Order for Professional Pilotage Services
2.(1)  Where the services of a pilot has been ordered for a vessel and the PSA has reserved its pilot for the vessel, for a request for cancellation or amendment to the order made less than 4 hours before the services are required —
(a)a fee of $150 shall be levied on each cancellation or amendment of the order in addition to the fee specified in item 1 whether or not the amendment has been accepted; and
(b)a fee equivalent to the use of the services for one hour under item 1 shall be levied where the amendment has not been accepted.
(2)  Where the order for the services of a PSA pilot is to move the vessel to more than one place, a single charge shall be levied for each cancellation.
Alongside or Waiting Charge
3.(1)  The following alongside or waiting charges shall be payable for the period commencing from the time of arrival of the waterboat at its destination to the time the waterboat operation is completed:
(a)$100 per hour or part thereof for a period not exceeding 2 hours; and
(b)$50 per ¼ hour or part thereof for a period exceeding 2 hours.
(2)  The PSA reserves the right to withdraw the waterboat at any time and, upon the withdrawal, the charges incurred under this item shall be payable.
Tug Services
4.(1)  The following charges shall be payable for the use of tugs (including for the supply of tow rope) for assisting or shifting a vessel to berth or unberth or for towing a vessel:

(2)  An oil rig of a vessel of unusual characteristic, including a vessel having special or emergency assistance, shall be charged according to the rate set out in paragraph (1)(j) regardless of it being a vessel of a particular gross tonnage set out in paragraph (1)(a) to (i).
(3)  The period for which a charge under this item for the use of a tug for assisting or shifting a vessel to berth or unberth or for towing a vessel is payable shall commence from the time the tug leaves the place where it is usually anchored or moored to the time the tug returns to such place.
Charges for Cancelling or Amending an Order for the Use of a Tug
5.(1)  Where an order for the use of a tug is cancelled or amended less than 2 hours before the tug is required, a fee, equivalent to that which would be payable if the tug was made use of for one hour, shall be payable for each cancellation or amendment.
(2)  Where a tug, which is ordered for, attends but is not made use of, a charge at the appropriate rate specified in item 4 shall be payable for the attendance of the tug.
Dockage
6.(1)  (a)  The following charges shall be payable by a vessel berthed at a PSA wharf for the purpose of loading or discharging goods or taking bunkers from the PSA pipelines for the period commencing from the time the vessel occupies the berth until the time it departs therefrom:
(i)at a PSA berth at Tanjong Pagar Terminal, Keppel Terminal or Brani Terminal
(A)where the LOA does not exceed 150 metres —
 
 $50 per hour or part thereof for the first 100 metres of LOA; and
 
 $2 per metre per hour or part thereof for any LOA in excess of 100 metres; or
 
(B)where the LOA exceeds 150 metres —
 
$150 per hour or part thereof for the first 150 metres of LOA; and
 
$4 per metre per hour or part thereof for any LOA in excess of 150 metres.
(ii)at a PSA berth at Pasir Panjang Terminal or Sembawang Terminal
$30 per hour or part thereof for the first 100 metres of LOA; and
 
$2 per metre per hour or part thereof for any LOA in excess of 100 metres.
(b)  Where a vessel overstays at a PSA berth, a charge of $4 per metre of LOA or part thereof per ¼ hour or part thereof shall be payable in lieu of the dockage charge payable under paragraph (a)(i) or (ii).
(c)  A vessel is deemed to have overstayed at a PSA berth if upon the expiration of the time which the vessel is permitted to continue to occupy the berth, it continues to occupy a PSA berth —
(i)at Tanjong Pagar Terminal, Keppel Terminal or Brani Terminal, 15 minutes after lifting of ramp on completion of roll-on roll-off operations or after completion of lashing of containers or of taking bunkers from the PSA pipeline or after completion of taking bunkers overside, as the case may be; or
(ii)at Sembawang Terminal or Pasir Panjang Terminal or at a PSA berth without quay cranes at Tanjong Pagar Terminal, one hour after completion of loading or discharging of the goods or of taking bunkers or after completion of taking bunkers overside, as the case may be, or 2 hours after such completion if the vessel is a parcel tanker.
(d)  Where the vessel has completed goods or container operations or bunkering activities more than one hour before the vessel's estimated time of unberthing as notified to the PSA, the period of overstay shall commence one hour before the vessel's estimated time of unberthing.
(2)  (a)  The following charges shall be payable by a passenger vessel berthed at the International Passenger Terminal for the period commencing from the time the vessel occupies the berth until the time it departs therefrom:
(i)where the LOA does not exceed 150 metres —
(A)$50 per hour or part thereof for the first 100 metres of LOA; and
(B)$2 per metre per hour or part thereof for any LOA in excess of 100 metres; or
(ii)where the LOA exceeds 150 metres —
(A)$150 per hour or part thereof for the first 150 metres of LOA; and
(B)$4 per metre per hour or part thereof for any LOA in excess of 150 metres.
(b)  The charge for a passenger vessel berthed at a PSA terminal other than the International Passenger Terminal shall be at the rate specified in paragraph (1)(a).
(c)  Except with the prior written approval of the PSA, no passenger vessel shall stay alongside a wharf for longer than the period stipulated by the PSA from time to time in a PSA terminal circular. Such stay shall be subject to such conditions as may be set out in the PSA terminal circular.
(3)  The charge for any other vessel berthed at a PSA wharf, jetty or pier other than the Singapore Cruise Centre is $5 per call of 20 minutes or part thereof.
Section II
CHARGES FOR CONTAINER OPERATIONS — PAYABLE BY THE OWNER, AGENT, CONTAINER OPERATOR, SHIPPER OR CONSIGNEE
     Stevedorage charges for the handling of a re-export container shall be at the rates specified in this Section in respect of the handling of FCL containers but the free storage period granted for re-export containers shall be the same as that for transhipment containers.
Stevedorage — Loading or Discharging FCL Containers
7.(1)  No export FCL container will be accepted by the PSA for loading unless such container is delivered to the PSA premises within such period as the PSA may specify from time to time in a PSA terminal circular.
(2)  The following charges for loading or discharging FCL container shall be payable:

8.(1)  The charges payable for the loading or discharging of transhipment containers shall be —

(2)  Where the on-carrying vessel of a loaded transhipment container is not correctly nominated within the period specified by the PSA from time to time in a PSA terminal circular, the following charges shall be paid by both the discharging and intended carrier:

(3)  The PSA may elect to collect the charges from the container operator.
(4)  A transhipment container sent to a container freight station for stuffing or unstuffing shall not qualify for the rate for transhipment containers and the appropriate rate for FCL containers shall apply.
Shifting Containers
9.  A charge at the rate of $125 per container shall be payable for each shifting operation, including landing or reshipping in respect of the container.
Uncontainerised Goods, Overheight or Overwidth Containers and Containers Stored Athwartship
10.(1)  The charges for the handling of a load or a container that can only be handled by a container quay crane or transfer equipment spreader with special attachments or manual slings are as follows:
(a)Stevedorage uncontainerised goods

(2)  If an overwidth container is capable of being handled like any normal container without the use of special attachments or manual slings and if the container is designed to fit a single purpose — built cell in the hold of the vessel, such overwidth container may qualify for stevedorage charges under item 7 or 8, as the case may be, in lieu of the charges payable under paragraph (1).
(3)  Where the agent fails to provide his own trailer or chassis with a tow-head to effect delivery of the uncontainerised goods or overheight or overwidth container which he is delivering to or from a vessel, an additional charge equivalent to 75% of the stevedorage charge on the goods or container shall be payable.
Containers containing Dangerous Goods
11.  The charges for the loading or discharging of a container containing dangerous goods are as follows:

  For an import container, the free storage period shall commence from the time the discharge of the container from the vessel is completed and if the free storage period is exceeded, store rent shall be payable for the period commencing from the time of completion of the discharge of the container from the vessel to the time of delivery of the container.
  For an export container, the free storage period shall commence from the time the container is received by PSA and if the free storage period is exceeded, store rent shall be payable for the period commencing from the time the container is received by PSA to the time the vessel, by which the container is to be exported, berths at a PSA wharf.
(d)  Transhipment or Re-export Container
(i)  An empty or a loaded transhipment or re-export container shall have 168 hours of free storage in a PSA container yard from the time of completion of discharge of the first vessel to the time of berthing of the second vessel. If the period exceeds 168 hours, store rent shall be charged for the period exceeding the 168 hours from the time of completion of discharge of the first vessel to the time of berthing of the second vessel.
(ii)  An overheight/overwidth container shall have 168 hours of free storage in a PSA container yard from the time of completion of discharge of the first vessel to the time of berthing of the second vessel. If the period between these two time exceeds 168 hours, store rent shall be charged at the rate specified in paragraph (1)(g) for the period exceeding 168 hours from the time of completion of discharge of the first vessel to the time of berthing of the second vessel.
(iii)  A container containing Group II dangerous goods shall have 72 hours free storage in a PSA container yard from the time of completion of discharge to the time of berthing of the second vessel. If this period of time exceeds 72 hours, store rent shall be charged at the rate specified in paragraph (1)(k) and for the period exceeding 72 hours from the time of completion of discharge of the first vessel to the time of berthing of the second vessel.
(e)Transhipment goods railed from a PSA terminal to another for stuffing and shipment
  Transhipment goods railed from one PSA terminal to another for stuffing and shipment shall have 168 hours free storage from the time of completion of discharge of the first vessel to the time the on-carrying vessel berths. If the period exceeds 168 hours, store rent shall be charged at rates specified under item 26 and for the period exceeding 168 hours from the time of completion of discharge of the first vessel to the time of completion of stuffing.
Extra Movements Charge
13.(1)  The following charges shall be payable:

(2)  The rates specified in paragraph (1)(c) are based on the Public Utilities Board’s electricity tariff as at 1st August 1995. The PSA reserves the right to increase or decrease the rates specified in paragraph (1)(c) from time to time.
Shut-Out Container
15.(1)  Where an export container or a transhipment container or a re-export container is shut-out and subsequently delivered out of PSA premises or to any container freight station, the following rates shall be payable:

(2)  Where a container to be exported is shut-out from the vessel by which it is to be exported and is subsequently shipped by a vessel —
(a)a charge at the appropriate rate specified in paragraph (1) shall be payable in addition to the stevedorage charge; and
(b)the container shall have free storage for the relevant period stated in item 12(2). If the free storage period is exceeded, the relevant store rent as stated in that item shall apply.
Change of Container from One Type or State to Another
16.(1)  In addition to the charges as adjusted payable under item 7 or 8, the following charges shall be payable in addition for any change of a container from one type or state to another:

(2)  The charges specified in paragraph (1) for changing the container from one type or state to another shall not be payable if the PSA is notified of the change at least 24 hours before the arrival of the vessel on or from which the container is to be loaded or discharged, as the case may be. If the change is requested 168 hours after the time of completion of discharge of the vessel from which the container is discharged, the charges payable under paragraph (1) for changing the container from one type or state to another shall be at double the rate specified therein.
Standby Charges for Labour and Equipment
17.(1)  The following standby charges shall be payable for the supply of labour and equipment by PSA:
Per quay crane
$300 for the first ¼ hour or part thereof
$100 for every subsequent 5 minutes or part thereof
(2)  Where labour and equipment are supplied by the PSA to handle containers in accordance with an order placed with the PSA for the use of a berth and the labour and equipment are kept standing-by, the charges specified in this item shall be payable as follows:
(a)if the quay cranes are kept standing-by because of the late arrival of the vessel caused by the owner or agent of the vessel, the charges shall be payable for the period commencing from 15 minutes after the estimated time of berthing of the vessel up to the actual time of its berthing; and
(b)if the labour and equipment are kept standing-by because of any delay, caused by the agent or owner of the vessel in starting operations after the arrival of the vessel or during operations, the charge shall be levied for the period commencing from the time of completion of berthing of the vessel up to the actual time of commencement of operations.
Lift On or Lift Off Charges
18.(1)  The charges specified under this item shall be payable in respect of all containers (except transhipment or re-export containers) —

(3)  A haulier who is a PSA account holder and is a user of the PSA’s PORTNET system and has installed transponders on his prime movers and chassis and has also complied with the PSA’s operating requirements shall, for the FCL import containers delivered by him during off-peak hours and within 48 hours from the time of completion of their discharge from the vessel or for FCL export containers received from him during off-peak hours and within 48 hours before the time of berthing of the vessel, be granted the following incentive rates:

Miscellaneous Charges for Export FCL Containers
19.(1)  Where a FCL export container is delivered to the PSA after the period specified by the PSA in the PSA terminal circular but arrives at Tanjong Pagar Terminal, Keppel Terminal or Brani Terminal before the arrival of the vessel by which the container is to be exported, the following charges shall be payable:

General
CHARGES FOR USE OF PREMISES, WORKS AND APPLIANCES AND
FOR SERVICES AND FACILITIES
Late advice, Cancellation or Amendment of Berth Application
27.(1)  Applications for occupation of a PSA berth shall be made at least 24 hours before the berth is required.
(2)  The PSA shall from time to time decide the period of notice required and the procedures for any amendment of the time when the berth is required and shall notify the same by a PSA terminal circular.
(3)  Where an application for a PSA berth is made or cancelled less than 24 hours before the berth is required or the estimated time of berthing, whichever is the later or where the owner, master or agent of any vessel fails to give to the PSA adequate notice of any amendment to the time when the berth is required or to the estimated time of berthing, the following fees shall be payable in addition to the charges payable under this item:

Wharfage on PSA wharf
28.(1)  A wharfage charge at the rate of $1.50 per tonne or part thereof shall be payable for goods delivered to or received from a vessel berthed alongside another vessel at a PSA wharf or passing over a PSA wharf.
(2)  The PSA may elect to collect the charge from the owner or agent of the vessel or the consignee or the shipper of the goods.
Wharfage and Labour on Bunkering Fuel
29.  A charge at the rate of $3 per tonne or part thereof shall be payable for loading bunkering fuel on or discharging bunkering fuel from a vessel alongside, without delivering the bunkering fuel through the PSA Common Oil Facilities.
Wharfage on Bulk Liquid Goods Except Bunkering Fuel
30.  The following wharfage charges shall be payable on bulk liquid goods except bunkering fuel:

Wharfage on Dangerous Goods
31.  A wharfage charge at the rate of $3 per tonne of goods or part thereof shall be payable for discharging or loading goods classified as dangerous goods pursuant to Part II of the Maritime and Port Authority of Singapore (Dangerous Goods, Petroleum and Explosives) Regulations 1997 (G.N. No. S 182/97) thereof, at such place as may be designated as a dangerous goods landing place in Part II of those Regulations.
Wharfage on Dry Bulk Goods
32.  The following wharfage charges shall be payable for goods discharged or loaded by bulk handling equipment other than that belonging to the PSA:

33.  A charge at the rate of $3 per 10 square metres or part thereof per 1/2 shift or part thereof per occasion shall be payable for the use of space inside or outside PSA warehouses or PSA transit sheds other than for the storage of goods.
Police Services
34.(1)  The charges payable for the services of members of the PSA auxiliary police force to protect persons and property shall be —

Passenger Wharfage
36.  Where passengers embark or disembark from passenger vessels or are in transit on passenger vessels berthed at a PSA terminal or the Singapore Cruise Centre, a charge of $10 per passenger per occasion of embarkation, disembarkation or transit shall be payable.
