(Registration of Pharmacists)
Regulations 2013
In exercise of the powers conferred by section 74 of the Pharmacists Registration Act, the Singapore Pharmacy Council, with the approval of the Minister for Health, hereby makes the following Regulations:
PART I
PRELIMINARY
Citation and commencement
1.  These Regulations may be cited as the Pharmacists Registration (Registration of Pharmacists) Regulations 2013 and shall come into operation on 5th March 2013.
Definition
2.  In these Regulations, unless the context otherwise requires, “medical practitioner” means a person registered under the Medical Registration Act (Cap. 174).
PART II
REGISTRATION OF PHARMACISTS
Application for registration as pharmacist
3.—(1)  The form to be used for the purpose of an application for registration as a pharmacist under the Act is that set out at the Council’s Internet website at http://www.spc.gov.sg, and every such application shall be accompanied by all of the following:
(a)a certified copy of the degree or other qualification referred to in section 16, 17 or 19 of the Act;
(b)a certified copy of the identity card or passport of the applicant;
(c)a certificate of registration as a pharmacist, or equivalent, in any foreign country if the applicant has been registered in that country;
(d)where applicable, a certificate of good standing from the registration body of a country where the applicant has been registered stating whether on the date of issue —
(i)the applicant is a registered pharmacist of that country; and
(ii)proceedings have been taken or are pending against him;
(e)any other information, statement or document required by the Council;
(f)the appropriate fee specified in the Schedule.
(2)  Any document produced under paragraph (1) which is not in English shall be accompanied by a certified translation thereof in English.
Application for registration as specialist
4.—(1)  The form to be used for the purpose of an application for registration as a specialist under the Act is that set out at the Council’s Internet website at http://www.spc.gov.sg, and every such application shall be accompanied by all of the following:
(a)a certificate obtained from the Board under section 37(2) of the Act;
(b)any other information, statement or document required by the Council;
(c)the appropriate fee specified in the Schedule.
(2)  In deciding whether to impose any condition or restriction under section 18(2)(a) of the Act, the Council shall have regard to the advice of the Board, under section 37(1)(f) of the Act, on any matters affecting, or connected with the registration of, a particular specialist or specialists generally.
Examinations for pharmacists
5.—(1)  An examination referred to in sections 17(2) and (3)(c), 19(2) and 26(4) of the Act (referred to in this regulation as the relevant provisions) shall be one on the following subjects:
(a)the basic principles of law, as applied to pharmacy in Singapore;
(b)the practice of pharmacy.
(2)  For the purpose of conducting any examination referred to in paragraph (1), the Council may —
(a)appoint a Committee of Examiners; or
(b)make such arrangements with the Department of Pharmacy of the National University of Singapore as may be necessary.
(3)  The date and place of any examination referred to in the relevant provisions of the Act and the manner in which the examinations are to be conducted shall be as set out at the Council’s Internet website at http://www.spc.gov.sg.
(4)  An applicant who is required by the Council to undergo any examination under the relevant provisions of the Act shall be entitled to only 3 attempts at each such examination.
Application to sit for examinations
6.  Every application to sit for an examination referred to in regulation 5 shall —
(a)be made in such form and manner as the Council may determine; and
(b)be accompanied by the appropriate fee specified in the Schedule.
Application for restoration
7.—(1)  An application for the restoration of any name to an appropriate register shall be made in such form and manner as may be set out at the Council’s Internet website at http://www.spc.gov.sg and shall be accompanied by the appropriate fee specified in the Schedule.
(2)  For the purposes of paragraph (1), the Council may require the applicant to furnish proof that he has adequate knowledge to practise pharmacy and, for that purpose, may require the applicant to attend such courses of instruction as the Council may determine.
(3)  In addition to the requirements in paragraph (2) —
(a)an application for the restoration of a name removed from an appropriate register under section 24(c)(iii) of the Act shall, unless the Council otherwise directs in any particular case, be supported by —
(i)a certificate of good standing issued by a professional body in the country where the applicant last practised, if applicable; and
(ii)a medical report by a medical practitioner approved by the Council certifying that the applicant is fit to practise pharmacy; and
(b)an application for restoration to the Register of Specialists shall be accompanied by a certificate obtained, within one month before the application, from the Board issued under section 37 of the Act.
(4)  The Council may, if it thinks fit in any case or class of cases, dispense with any requirement referred to in this regulation.
(5)  The Council may, if it thinks fit, require further evidence or information from an applicant under this regulation.
Consideration of applications by Council
8.—(1)  On receipt of an application referred to in regulation 7, the Registrar shall refer the application to the Council for consideration.
(2)  Except with the leave of the Council, the applicant shall not appear before the Council on the consideration of the application.
(3)  The Council shall consider the application in private and may, if it thinks fit, adjourn the consideration to a future date or require the applicant to be examined by medical practitioners to be appointed by the Council.
PART III
GENERAL
Disclosure of information
9.  The Registrar may disclose any information in any register to any public officer in a Government department or any officer of a statutory board if the Registrar is satisfied that —
(a)such disclosure is necessary to enable the Government department or statutory board concerned to perform its public duty or discharge its functions; or
(b)such disclosure is in the interest of public safety.
Certificate of good standing
10.  The Council may, upon the application made by a registered pharmacist in such form as the Council may require and accompanied by the appropriate fee specified in the Schedule, issue to the registered person a certificate of good standing stating that on the date of its issue —
(a)the person is a registered person; and
(b)no disciplinary proceedings have been taken or are pending against him.
Application for certified true copy of certificate of registration
11.  An application for a certified true copy of a certificate of registration shall be made in such form and manner as the Council may require and shall be accompanied by the appropriate fee specified in the Schedule.
Duplicate of certificate of registration
12.—(1)  Where a certificate of registration has been lost or destroyed, or has been defaced or obliterated such that any particulars in the certificate are illegible, the holder thereof shall immediately apply to the Council for a duplicate of the certificate of registration.
(2)  Subject to paragraphs (4) and (5), the Council shall, on payment of the appropriate fee specified in the Schedule, if it is satisfied that the certificate of registration has been lost, destroyed, defaced or obliterated, issue a duplicate of such certificate to the holder of the original thereof.
(3)  A duplicate of a certificate of registration shall have the same effect as the original.
(4)  In the case of a certificate of registration which has been defaced or obliterated, no duplicate of such certificate shall be issued unless the original certificate is returned to the Council.
(5)  In the case of a certificate of registration which has been lost or destroyed, no duplicate of such certificate shall be issued unless the holder thereof makes a statutory declaration of the loss or destruction and furnishes the statutory declaration to the Council.
(6)  Where any original certificate of registration is found after any duplicate thereof is issued under this regulation, the holder of the certificate shall, within 14 days after the original certificate being found, return the duplicate to the Council for cancellation.
(7)  Any person who fails to comply with paragraph (6) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000.
Revocation, savings and transitional provisions
13.—(1)  The Pharmacists Registration Rules (R 2) (referred to in this regulation as the revoked Rules) are revoked.
(2)  Notwithstanding anything in these Regulations, an application for registration made in accordance with the revoked Rules and pending on 5th March 2013 shall be treated as an application made under the corresponding provisions of these Regulations.
(3)  Notwithstanding anything in these Regulations, an application for restoration of registration made in accordance with the revoked Rules and pending on 5th March 2013 shall be treated as an application made under the corresponding provisions of these Regulations.
