Citation

1.  These Rules may be cited as the Parking Places (Parking of Heavy Vehicles) Rules.

Definitions

2.  In these Rules, unless the context otherwise requires —

“designated parking space” means a parking lot or other space in a parking place or a private parking place in which the registered owner of, or the person who has purchased, a heavy vehicle is authorised by the Superintendent or licensee, as the case may be, to park the heavy vehicle;

“officer” means an officer authorised by the Superintendent;

“parking lot” means the space marked out in a parking place or a private parking place for the parking of one heavy vehicle;

“private dwelling-house” means any building, flat or tenement wholly or principally used or occupied for residential purposes;

“private parking place” means a private parking place that is licensed for the parking of one or more heavy vehicles under the Parking Places (Licensing and Control of Private Parking Places for Heavy Vehicles) Rules (R 1);

“registered owner”, in relation to a heavy vehicle, means the person who is registered under the Road Traffic Act (Cap. 276) as the owner of the heavy vehicle;

“registration”, in relation to a heavy vehicle, means the registration of the heavy vehicle under section 10 of the Road Traffic Act;

“vehicle licence” means a vehicle licence issued under section 13 of the Road Traffic Act;

“vehicle parking certificate” means a vehicle parking certificate issued under these Rules.

Restriction of parking of heavy vehicles

3.  No person who maintains or operates a parking place which is used in connection with private dwelling-houses shall at any time allow a heavy vehicle to be parked in the parking place.

4.—(1)  Every person who is the registered owner of, or who has purchased, a heavy vehicle shall, subject to paragraphs (2) and (3), procure a designated parking space for the parking of the heavy vehicle.

(2)  Every person who is the registered owner of, or who has purchased, 2 or more trailers may procure one designated parking space for the parking of not more than 3 such trailers.

(3)  Notwithstanding paragraph (2), every person who is the registered owner of, or who has purchased, 2 or more 20-foot trailers may procure one designated space for the parking of not more than 6 such trailers.

(4)  Every person who is the registered owner of, or who has purchased, a heavy vehicle shall, upon compliance with paragraph (1), (2) or (3) as the case may be, apply for a vehicle parking certificate in respect of the heavy vehicle.

(5)  An application for a vehicle parking certificate by a registered owner, or by a person who has procured one designated space under paragraph (3) for the parking of not more than 6 20-foot trailers shall be accompanied by a declaration made by the registered owner or person in such form as the Authority may require.

(6)  Every vehicle parking certificate shall be in such form and shall state such particulars as may be required by the Superintendent.

(7)  This rule does not apply to the registered owner of, or a person who has purchased, a trailer, container trailer, low loader or flat-bed trailer, the maximum laden weight of which exceeds 5,000 kilograms for the period between 6 February 2026 and 5 February 2028 (both dates inclusive).

Application for vehicle parking certificate

5.—(1)  Every application for a vehicle parking certificate shall be made to the officer or a licensee from whom the applicant has procured a designated parking space for the parking of his heavy vehicle.

(2)  Every application for a vehicle parking certificate must be in such form as the Superintendent may require and a fee of $6 is payable.

(3)  Where payment of the fee mentioned in paragraph (2) is tendered in a form other than cash and the payment is subsequently dishonoured or otherwise not effected, an additional fee for processing the dishonoured payment of $32.10 (inclusive of GST) is payable.

(4)  The Superintendent may, in his discretion, waive in whole or in part the fee payable by an applicant under paragraphs (2) and (3).

Duration of vehicle parking certificate

6.—(1)  Every vehicle parking certificate shall, subject to rule 8, be valid for the period for which the person to whom it is issued has procured a designated parking space for the parking of his heavy vehicle.

(2)  No licensee shall authorise the owner of any heavy vehicle to park the heavy vehicle in a designated parking space in the private parking place maintained or operated by him, or issue any vehicle parking certificate, for a period which exceeds the expiry date of his licence under the Parking Places (Licensing and Control of Private Parking Places for Heavy Vehicles) Rules (R 1) to maintain or operate the private parking place.

Cessation of validity of vehicle parking certificate

8.—(1)  A vehicle parking certificate shall cease to be valid if —

(a) the ownership of the heavy vehicle is transferred to another person;

(b) the registered owner of the heavy vehicle ceases to be authorised to park the heavy vehicle in the designated parking space;

(c) the period for which the vehicle parking certificate was issued has expired; or

(d) the holder of the vehicle parking certificate surrenders the vehicle parking certificate to the officer or licensee who issued the vehicle parking certificate.

(2)  The holder of a vehicle parking certificate shall immediately inform in writing the officer or licensee who issued the vehicle parking certificate to him of the occurrence of any of the events specified in paragraph (1)(a) or (b).

Licensee to inform Superintendent of cessation of operation

10.—(1)  Any licensee who intends to cease the operation of his private parking place shall, unless the Superintendent otherwise allows, give at least 3 months’ notice in writing of his intention to the Superintendent and to every registered owner of a heavy vehicle who has been authorised by him to park the heavy vehicle in his private parking place.

(2)  Where upon the occurrence of any event which is beyond the control of a licensee it becomes impossible or impracticable for him to continue with the operation of his private parking place, he shall immediately give notice of the cessation of his operation of his private parking place to the Superintendent and to every registered owner of a heavy vehicle who has been authorised by him to park the heavy vehicle in his private parking place.

Directions to officers and licensees

11.  The Superintendent may, from time to time, issue to any officer or licensee such directions as he may consider necessary for carrying out the provisions of these Rules, and the officer or licensee shall comply with such directions.

Offences

12.—(1)  Any person who uses a vehicle parking certificate which was not issued to him or which has been cancelled or which for some other reason is invalid shall be guilty of an offence.

(2)  Any person who makes, in relation to an application for a vehicle parking certificate under these Rules, any statement or declaration which is false shall be guilty of an offence.
