Planning (Leases and Disposal of Land) (Consolidation) Order

Citation

1.  This Order may be cited as the Planning (Leases and Disposal of Land) (Consolidation) Order.

Additional leases not regarded as disposal of land

2.  Any lease granted on or after —

(a) 7th November 2003 for a term not exceeding an aggregate of 21 years of

(i) any unit in any development described in Part I of the Third Schedule to the Act; or

(ii) any building or part thereof comprised in a development described in Part II of the Third Schedule to the Act;

(b) 5th July 2004 for a term not exceeding an aggregate of 21 years of any building or part thereof comprised in such development which is or is to be lawfully used as a business park or science park; or

(c) 3 October 2022 for a term not exceeding an aggregate of 35 years, of any unit in a building or part thereof where written permission has been granted for the development of the building or part for use as an assisted living facility,

shall be added to the list of leases in section 4(2) of the Act which shall not be regarded as a disposal of land.
