Oral History Sound Recordings and
Transcripts Regulations

Citation
1.  This Regulations may be cited as the Oral History Sound Recordings and Transcripts Regulations.
Definitions
2.  In these Regulations —
“Director” means the Director, Oral History Department;
“interviewee”, in relation to any oral history sound recording or transcript, means the person from whom the recording or transcript was taken;
“oral history sound recording” means the sound recording of any oral history interview which is produced, received or acquired by and in the custody of the Centre;
“transcript” means the verbatim transcript of any oral history sound recording.
Control of recordings and transcripts
3.—(1)  No person shall —
(a)use;
(b)publish or reproduce the whole or any part of the contents of; or
(c)remove from the Centre,
any oral history sound recording or transcript without the written approval of the Director.
(2)  Where the use of an oral history sound recording or transcript is subject to any restriction under an agreement with the interviewee, the Director shall not —
(a)give his approval under paragraph (1);
(b)make or supply any copy of the recording or transcript; or
(c)do anything which is inconsistent with any restriction imposed under the agreement,
unless he has the written permission of the interviewee or his personal representative.
Research
4.—(1)  Any person may, for the purpose of reference or research, apply in writing to the Director to use any oral history sound recording or transcript.
(2)  An applicant shall state his name, address, identity card or passport number and the purpose for the use of the recording or transcript.
(3)  On receipt of an application, the Director shall consider the application and may, subject to regulation 3(2) and to such conditions as he may impose, allow the applicant to use the recording or transcript or refuse the use of the recording or transcript.
(4)  All oral history sound recordings and transcripts shall only be used in the search room of the Centre unless otherwise authorised by the Director.
(5)  (a) Subject to this regulation, any oral history sound recording or transcript may be borrowed for such period as the Director may determine.
(b) The Director may at any time recall the recording and transcript.
(6)  The applicant shall be responsible for any oral history sound recording, transcript or tape-recorder borrowed by him and may be required to pay compensation for the loss of or damage to any recording, transcript or tape-recorder borrowed by him at such rate as the Director may determine having regard to the replacement or other costs of the recording, transcript or tape-recorder lost or damaged.
Use of Centre and fees
5.—(1)  The Director may in his discretion permit any part of the Centre to be used by any person subject to such conditions as he thinks fit and on payment of such fee as he may with the approval of the Minister determine.
(2)  There shall be paid to the Director in respect of the matters set out in the first column of the Schedule the fees set out in the second column.
(3)  The Director may in his discretion waive or refund wholly or in part any fee payable under these Regulations.
Penalty
6.  Any person who contravenes or fails to comply with regulation 3(1) or any condition imposed by the Director under regulation 4(3) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both.
Discipline within Centre
7.  Any person who behaves in a disorderly or improper manner may be required to leave the Centre and may subsequently be refused admission to the Centre by the Director or any officer of the Centre.
