Whereas —
(a)Malaysia is a party to the Basel Convention;
(b)Malaysia has, by notification through the Secretariat of the Basel Convention, informed Singapore of its national definition of hazardous wastes;
(c)the Minister is satisfied that the substances, objects or wastes specified in the notification of Malaysia are, in particular circumstances or for particular purposes, classified as hazardous or other wastes under the law of Malaysia; and
(d)apart from section 5 of the Hazardous Waste (Control of Export, Import and Transit) Act 1997, those substances, objects or wastes are not hazardous or other wastes in Singapore.
Now, therefore, in exercise of the powers conferred by section 5 of the Hazardous Waste (Control of Export, Import and Transit) Act 1997, the Minister for Sustainability and the Environment makes the following Notification:

1.  This Notification is the Hazardous Waste (Extended Meaning of Hazardous and Other Wastes — Malaysia) Notification 2005.
Declared substances, objects or other wastes
2.  The substances, objects or other wastes set out in the Schedule are, in the circumstances or for the purposes specified in the Schedule, declared to be hazardous or other wastes in relation to Malaysia so far as they are not hazardous or other wastes apart from section 5 of the Act.
