(Aviation Industry — Class Licence)
Order 2025
In exercise of the powers conferred by section 56 of the Guns, Explosives and Weapons Control Act 2021, the Minister for Home Affairs makes the following Order:
PART 1
PRELIMINARY
Citation and commencement
1.  This Order is the Guns, Explosives and Weapons Control (Aviation Industry — Class Licence) Order 2025 and comes into operation on 1 July 2025.
Definitions
2.—(1)  In this Order —
“acceptable storage requirement”, in relation to any controlled item of an aircraft —
(a)for any firearm, firearm gun part or firearm gun accessory that is designed to be or can be fitted to, or is adapted to fit, a firearm, or for any ammunition, means —
(i)keeping in a locked and non‑portable receptable on board the aircraft which must not be in operation and is under guard at all times by 2 or more auxiliary police officers while armed with firearms; or
(ii)storing at an armoury in Singapore under the control of a permissible custodian authorised by or under the Act to store that firearm, firearm gun part, gun accessory or ammunition; or
(b)for any other gun, gun part or gun accessory, or any weapon, means keeping in a locked and non‑portable receptable on board the aircraft which must not be in operation;
“aerial work operation” means an operation of an aircraft that involves any of the following kinds of operation:
(a)an external load operation, which consists of carrying or towing a load outside the aircraft in flight, such as but not limited to glider towing, banner towing, and winching or target towing an individual during a search and rescue operation;
(b)a dispensing operation, which consists of dropping or releasing any substance or object from an aircraft in flight, such as but not limited to dropping or spraying onto the ground or water any fertiliser, water or pesticides for agricultural, horticultural or primary production purposes, cloud seeding, dropping or spraying onto the ground or water any fire retardant for firefighting or search and rescue purposes, and carrying any individual undertaking a parachute descent from the aircraft in flight;
(c)a task specialist operation, which consists of carrying out any other specialised activity using an aircraft in flight, such as for construction, photography, skywriting or other aerial advertising, scientific research, search and rescue, or forest and wildlife conservation,
and includes training for any such an operation or specialised activity;
“air service” means a service —
(a)for the carriage of one or more passengers, mail or cargo for reward in an aircraft on a flight; or
(b)for the carriage of one or more passengers, mail or cargo gratuitously in an aircraft on a flight by a person whose business includes the carriage by air of passengers or cargo for reward,
but excludes a service consisting of providing a course of training or instruction in flying an aircraft;
“aircraft” means any machine that can derive support in the atmosphere from the reactions of the air otherwise than by the reactions of the air against the surface of the earth, but not —
(a)an unmanned aircraft; or
(b)a naval, military or air force aircraft, or a State‑owned aircraft, of any country, which the Ministry of Foreign Affairs or Ministry of Defence in Singapore requests to be treated not as an aircraft for the purposes of this Order;
“airport” means any defined area of land in Singapore declared under section 3 of the Civil Aviation Authority of Singapore Act 2009 to be an airport;
“authorised by or under the Act”, for a regulated activity involving any gun, gun part or gun accessory, or any ammunition or weapon, means authorised to carry on the regulated activity, without committing an offence under the Act, because of —
(a)a provision in the Act;
(b)a licence or a class licence; or
(c)an exemption by or under section 87, 88 or 89 of the Act;
“auxiliary police officer” means a member of an Auxiliary Police Force created under the Police Force Act 2004;
“baggage” means the personal property of any passenger or crew that is carried on an aircraft by agreement with the operator of the aircraft, regardless if checked‑in baggage or a carry‑on article;
“border authority” means —
(a)a police officer;
(b)an officer of customs within the meaning given by section 3(1) of the Customs Act 1960 who is deployed at an airport; or
(c)the Controller of Immigration or an immigration officer appointed under section 3 of the Immigration Act 1959 who is deployed at an airport;
“cargo” means any property carried on an aircraft other than the following:
(a)mail;
(b)stores and any goods intended for use and sale, respectively, on an aircraft, including spare parts and other articles of equipment;
(c)baggage, whether or not accompanied or mishandled;
“controlled item”, in relation to an aircraft, means any gun, gun part or gun accessory, or any ammunition or weapon, that is —
(a)the cargo of the aircraft; or
(b)the baggage of any passenger or crew of the aircraft,
and for the purposes of Part 2, includes the baggage of the pilot‑in‑command of the aircraft;
“crew”, in relation to an aircraft, includes every individual having duties or functions on board the aircraft during its flight in connection with the flying or safety of the aircraft but excludes the pilot‑in‑command;
“firearm” means a gun that —
(a)is designed or adapted to fire bullets, shots or other projectiles by means of burning propellant; and
(b)if used in the way for which it is designed or adapted, is capable of being aimed at a target and causing hurt or injury by propelling a bullet, shot or another projectile;
“firearm gun part” means a major part of a gun which is a firearm;
“gun part”, for a gun, means a major part of a gun;
“operation of an aircraft” has the meaning given by sub‑paragraph (3);
“operator”, in relation to an aircraft, means the person who, at the relevant time, is engaged in, or offering to engage in, conducting an air service or aerial work operation by the use of the aircraft;
“passenger” means an individual boarding or intending to board an aircraft for the purpose of travelling on board as a passenger, but excludes a participant of an aerial sports activity or flying exhibition involving that aircraft;
“permissible custodian”, for any gun, gun part or gun accessory, ammunition or weapon, means —
(a)a border authority charged to keep temporary custody of the gun, gun part or gun accessory, ammunition or weapon; or
(b)a person who first produces an acceptable proof of the other person’s authorisation by or under the Act to possess or handle such a gun, gun part or gun accessory, ammunition or weapon;
“pilot‑in‑command”, in relation to an aircraft, means —
(a)the pilot designated by the operator of the aircraft as being in command and charged with the safe conduct of a flight using that aircraft; or
(b)if no pilot under paragraph (a) is designated, an individual who is, for the time being, in charge of the piloting of the aircraft without being under the direction of any other pilot in the aircraft;
“unloaded”, for a gun, means not loaded with any ammunition, paintball, airgun pellets or other projectiles.
(2)  The time delimited for the purposes of paragraph 6(a) or 8(a) is —
(a)before the aircraft takes off from the departure aerodrome on a flight to Singapore, unless sub‑paragraph (b) or (c) applies;
(b)2 hours before the aircraft lands in Singapore if that flight is less than 2 hours in duration; or
(c)without delay after landing at an airport in Singapore if that airport is not the aerodrome or heliport of intended landing for the flight.
(3)  For the purposes of this Order, an “operation of an aircraft” takes place between the time any individual boards the aircraft with the intention of flight until such time as all individuals have disembarked.
Application to aircraft on certain flights only
3.—(1)  This Order applies only with respect to an aircraft that arrives in Singapore, on or after 1 July 2025, from a place outside Singapore on a flight —
(a)that is either —
(i)a non‑scheduled flight; or
(ii)a non‑commercial flight;
(b)that arrives at an airport in Singapore in one of the following circumstances:
(i)because it has become impossible or inadvisable to land at the aerodrome or heliport of intended landing for that flight;
(ii)the airport is the aerodrome or heliport of intended landing for that flight; and
(c)that subsequently leaves Singapore as soon as is practicable or as planned after so arriving.
(2)  For the purposes of this paragraph —
“freight air service” means an air service for the carriage of wholly or mainly mail or cargo;
“non‑commercial flight” means a flight of an aircraft that is neither a scheduled flight nor a non‑scheduled flight, and in which —
(a)the aircraft —
(i)is operated by an individual recreationally; and
(ii)is flown by the individual, or one or more pilots employed by the individual to fly the aircraft; or
(b)the aircraft —
(i)is used by a person in aid of the conduct of the person’s business, being a business other than conducting a passenger air service, a freight air service or any aerial work operation; and
(ii)is flown by the person, or one or more pilots employed by the person to fly the aircraft;
“non‑scheduled flight” means a flight on a non‑scheduled journey in respect of which a permit is required by the Air Navigation (Licensing of Air Services) Regulations (Rg 2);
“passenger air service” means an air service for the carriage of one or more passengers for reward and excludes a freight air service;
“scheduled flight” means a flight on a scheduled journey within the meaning given by regulation 2 of the Air Navigation (Licensing of Air Services) Regulations.
Prohibited guns, etc., not covered by class licence
4.  Nothing in this Order authorises the use or handling of any of the following:
(a)a prohibited gun;
(b)a prohibited gun accessory;
(c)a prohibited explosive;
(d)a prohibited weapon;
(e)an explosive precursor;
(f)a noxious substance;
(g)an explosive that is not ammunition.
