(Gun Disposal — Class Licence)
Order 2025
In exercise of the powers conferred by section 56 of the Guns, Explosives and Weapons Control Act 2021, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Guns, Explosives and Weapons Control (Gun Disposal — Class Licence) Order 2025 and comes into operation on 1 July 2025.
Definitions
2.  In this Order —
“contact address” means the address of —
(a)for a partnership (other than a limited liability partnership) — the partnership’s principal place of business in Singapore;
(b)for a body corporate — the body corporate’s registered office or principal office in Singapore;
(c)for an unincorporated association — the unincorporated association’s principal office in Singapore;
(d)for an individual carrying on business as a sole proprietor — the individual’s principal place of business in Singapore; or
(e)for any other individual — the individual’s place of residence or workplace in Singapore;
“destroy”, in relation to any gun, means to destroy the gun and render it harmless by melting or crushing the gun;
“identification mark”, for a gun, means a number, or a combination of numbers and letters, that —
(a)is unique to the gun; and
(b)is required by written law to be stamped, engraved or otherwise marked on a part of the gun that is on the outside surface of the gun where it can be easily seen;
“identity particulars” means —
(a)for an individual —
(i)the full name of the individual;
(ii)the number of the individual’s identity card, or the individual’s passport or work pass if he or she is not a citizen of Singapore; and
(iii)the nationality of the individual; or
(b)for an entity —
(i)the full name of the entity;
(ii)the country where the entity was incorporated or otherwise formed; and
(iii)the Unique Entity Number (UEN) of the entity, where available.
Class licence for smelter, etc.
3.  Unless exempt by or under section 87 or 88 of the Act and subject to section 66(1) and (2)(c) of the Act, every person who carries on any business involving —
(a)melting, smelting and refining of metals; or
(b)operating an incinerator or any plant, machinery or apparatus used for the processing, recycling or treatment of industrial waste,
is subject to a class licence authorising the person to dispose of any gun by destroying it in the course of that business, and to possess and acquire any gun for the purpose of so destroying it.
Conditions of smelter’s, etc., class licence
4.  A class licensee by virtue of paragraph 3 may possess, acquire and dispose of a gun subject to all the following conditions:
(a)the class licensee takes all reasonable steps necessary to ensure that every gun acquired by or coming into the possession of the class licensee for the purpose of disposal is destroyed without delay;
(b)the class licensee takes all reasonable steps necessary to ensure that the destruction of every gun acquired by or coming into the possession of the class licensee, takes place in the presence and in the view of —
(i)any individual mentioned in section 87(1)(a), (b), (c), (d), (e), (f), (g), (h), (i), (j) or (n) of the Act; or
(ii)a member of the Singapore Armed Forces, whether or not in regular service or national service, and includes an operationally ready national serviceman and a volunteer;
(c)after destroying any gun, the class licensee immediately certifies in writing that fact and give a copy of the certificate to the individual mentioned in sub‑paragraph (b) before whom the destruction of the gun was carried out.
Class licence for gun owner handling with view to dispose
5.  Unless exempt by or under section 87 or 88 of the Act and subject to section 66(1) and (2)(c) of the Act, every licensee who owns a gun (whether or not in the course of any business) and is handling the gun with a view to its destruction by —
(a)a class licensee by virtue of paragraph 3; or
(b)a person who is authorised under a licence to dispose guns,
is subject to a class licence authorising the person to dispose of the gun.
Conditions of gun owner’s class licence
6.—(1)  A class licensee by virtue of paragraph 5 may handle a gun with a view to its destruction by a person mentioned in paragraph 5(a) or (b), subject to all the following conditions:
(a)the class licensee gives a Licensing Officer written notice, at least 14 days before the date the gun is to be destroyed, stating —
(i)the proposed disposal of the gun, and that date;
(ii)the identity particulars and contact address of every individual before whom the destruction of the gun is to be carried out; and
(iii)the identification mark of the gun;
(b)before the gun is destroyed, the class licensee takes all reasonable steps necessary to secure the gun from loss or theft, or unauthorised access to it by a person who is not authorised by or under the Act to possess the gun;
(c)the class licensee gives to a Licensing Officer, within 7 days after the destruction of the gun, a certificate from a person mentioned in paragraph 5(a) or (b) that provides evidence of the destruction of that gun.
(2)  For the purpose of sub-paragraph (1)(b), “authorised by or under the Act”, for possession of a gun, means authorised to possess the gun without committing an offence under the Act, because of —
(a)a provision in the Act;
(b)a licence or a class licence; or
(c)an exemption by or under section 87, 88 or 89 of the Act.
Record-keeping
7.  For the purpose of section 61(2)(a) of the Act, a class licensee by virtue of paragraph 3 must make and keep a record of all the following aspects of the class licensee’s disposal of any gun under the class licence under this Order:
(a)the identification mark (if any) of every gun disposed by the class licensee;
(b)the date of every disposal of a gun carried out by the class licensee;
(c)the date on which each gun was acquired or received by the class licensee for disposal;
(d)the type and quantity of the gun acquired or received by the class licensee on each occasion for disposal;
(e)the identity particulars and contact address of every person from whom each gun mentioned in sub‑paragraph (d) was acquired or received by the class licensee for disposal.
How long to keep records required
8.  For the purpose of section 61(2)(a) of the Act, a class licensee by virtue of paragraph 3 must keep and retain a record for at least 3 years after the date the record was made.
