Gambling Control
(Singapore Sweep Ticket Retail Sale —
Exemption) Order 2022

In exercise of the powers conferred by section 128 of the Gambling Control Act 2022, the Minister for Home Affairs makes the following Order:

Citation and commencement

1.  This Order is the Gambling Control (Singapore Sweep Ticket Retail Sale — Exemption) Order 2022 and comes into operation on 1 August 2022.

Definitions

2.  In this Order, unless the context otherwise requires —

“convenience store” means a stall or small shop selling principally a variety of small household items, toiletries, pre‑packed food and drinks or other small consumer goods, whether or not other goods or services are available for sale or hire at the stall or shop, but does not include a supermarket or grocery shop;

“customer” means a person who purchases a Singapore Sweep ticket to participate in the Singapore Sweep;

“licensee” means Singapore Pools (Private) Limited where authorised by licence to conduct the Singapore Sweep;

“relevant agent” means —

(a) an entity which is a gambling service agent of the licensee in relation to the conduct of the Singapore Sweep;

(b) an individual who is a gambling service agent of the licensee in relation to the conduct of the Singapore Sweep; or

(c) an employee of a gambling service agent mentioned in paragraph (a) or (b) acting in the course of his or her employment;

“relevant reseller” means an individual who is not a young person, or is an entity, who or which acquires 2 or more Singapore Sweep tickets —

(a) for sale on consignment from —

(i) the licensee or a relevant agent; or

(ii) any other person where the other person consigning had acquired the Singapore Sweep tickets from the licensee or a relevant agent or from another person mentioned in this sub‑paragraph;

(b) for the purpose of selling, with the consent (express or implied) of the licensee, on consignment those tickets to customers; and

(c) not as a customer;

“sell”, for any goods or services, means —

(a) sell by retail the goods or services; or

(b) expose or display as an invitation to treat offering the goods or services in circumstances corresponding to a retail sale;

“Singapore Sweep” means the public lottery known as the Singapore Sweep Draw, the conduct of which is authorised by a licence granted to the licensee;

“Singapore Sweep ticket” means a card, document, paper or other token of a similar kind that —

(a) is printed by or on behalf of the licensee;

(b) has pre‑printed (whether on the front or rear) by the licensee or a relevant agent all of the following:

(i) the name of the licensee;

(ii) the price of each ticket;

(iii) the date of the draw;

(iv) the identifying serial number of the ticket to verify its authenticity;

(v) the unique 7‑digit lottery number of the ticket to be used in the draw, which is a number assigned to the ticket without selection by or any direction of any customer; and

(c) is evidence of the ticket holder’s participation, or a right to participate, in the Singapore Sweep;

“young person” means an individual who is below 21 years of age.

Retail point of sale to customers of Singapore Sweep tickets

3.—(1)  A relevant agent —

(a) who conducts the Singapore Sweep by selling to customers any Singapore Sweep ticket in any place or premises in Singapore that is not an approved gambling venue for the conduct of that public lottery; and

(b) who does not conduct, in or from the same place or premises, any betting operation or any gaming or any other lottery,

is exempt from section 19(1) of the Act with respect to that place or those premises.

(2)  A relevant reseller —

(a) who conducts the Singapore Sweep by selling to customers any Singapore Sweep ticket in any place or premises in Singapore that is not an approved gambling venue for the conduct of that public lottery; and

(b) who does not conduct, in or from the same place or premises, any betting operation or gaming or any other lottery,

is exempt from section 18(1) of the Act, and from section 19(1) of the Act with respect to that place or those premises.

Distributing Singapore Sweep tickets for sale on consignment

4.—(1)  A relevant agent —

(a) who conducts the Singapore Sweep in any place or premises in Singapore that is not an approved gambling venue for the conduct of that public lottery —

(i) by printing any Singapore Sweep ticket; and

(ii) then by distributing any Singapore Sweep ticket by way of consigning them for sale; and

(b) who does not conduct, in or from the same place or premises, any betting operation or any gaming or any other lottery,

is exempt from section 19(1) of the Act with respect to that place or those premises.

(2)  A person other than a relevant agent —

(a) who conducts the Singapore Sweep in any place or premises in Singapore that is not an approved gambling venue for the conduct of that public lottery by distributing any Singapore Sweep ticket by way of consigning them for sale; and

(b) who does not conduct, in or from the same place or premises, any betting operation or any gaming or any other lottery,

is exempt from section 18(1) of the Act, and from section 19(1) of the Act with respect to that place or those premises.

Employing young person to conduct Singapore Sweep

5.—(1)  A relevant agent (but not an employee of a gambling service agent) is exempt from section 35(1) of the Act with respect to the relevant agent employing in Singapore a young person to conduct the Singapore Sweep, in accordance with arrangements made by the relevant agent on behalf of the licensee, in or from any part of a convenience store, magazine or newspaper kiosk or shoplet, petrol service station, laundry shop, dry cleaner’s shop, hairdresser, or any other premises used for a trade or business of selling goods or services (whether or not of a similar kind) that —

(a) is occupied by the relevant agent for carrying on a business; and

(b) is not used to conduct —

(i) any betting operation or gaming;

(ii) the Singapore Sweep by way of printing and then distributing any Singapore Sweep ticket by consigning them for sale; and

(iii) any other lottery.

(2)  In sub‑paragraph (1), “employ”, in relation to a young person, includes —

(a) employing or engaging the young person whether or not under a contract of employment; and

(b) causing or permitting the young person to be employed or engaged.
