Order 2022
In exercise of the powers conferred by section 103 of the Fire Safety Act 1993, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Fire Safety (Installation of EV Chargers — Exemption) Order 2022 and comes into operation on 19 May 2022.

Exemption
2.—(1)  Sections 55, 56 and 60 of the Act and regulation 17 of the Fire Safety (Building and Pipeline Fire Safety) Regulations (Rg 1) do not apply in relation to the installation of any EV charger.

(2)  Sub-paragraph (1) does not apply in relation to —
(a)the installation of an EV charger that is located within a petrol station; or
(b)the installation of an EV charger that is also a battery swap station.

(3)  In this paragraph —
“battery”, in relation to an electric vehicle, means a rechargeable energy storage system which can be recharged with electricity externally so as to derive power to propel an electric vehicle equipped with that rechargeable energy storage system;
“battery swap station” means a device that is used to store one or more swappable batteries to enable the exchange of a swappable battery that is depleted in whole or in part with a swappable battery that is fully charged, whether or not the device is capable of transferring electricity from a supply source to the swappable batteries stored in the device;
“electric vehicle” means a motor vehicle that is —
(a)propelled wholly or partly by electricity, whether or not designed or adapted to be capable, in at least some circumstances or situations, of safely driving itself; and
(b)equipped with a battery;
“EV charger” means any device that is used to supply electricity to the battery of an electric vehicle for the purpose of charging the battery, including any wiring, fitting or apparatus (but not the isolator) connected to the device for that same purpose;
“swappable battery”, in relation to an electric vehicle, means a battery of the electric vehicle that, if depleted in whole or in part, is designed to be removed from the electric vehicle and exchanged for a recharged battery for the purpose of the propulsion of the electric vehicle.
