Management (YTL PowerSeraya Pte. Limited —
Exemption) Order 2023

In exercise of the powers conferred by section 75 of the Environmental Protection and Management Act 1999, the National Environment Agency makes the following Order:

Citation and commencement

1.  This Order is the Environmental Protection and Management (YTL PowerSeraya Pte. Limited — Exemption) Order 2023 and comes into operation on 21 July 2023.

Definitions

2.  In this Order —

“dispatch instruction” means a dispatch instruction issued under section 9.1.3 of Chapter 5 of the market rules that —

(a) relates to a specified open cycle gas turbine or specified steam plant; and

(b) requires the specified open cycle gas turbine or specified steam plant (as the case may be) to be operated at a loading level that is equal to or exceeds the loading level specified in the dispatch instruction;

“Energy Market Authority of Singapore” means the Energy Market Authority of Singapore established under the Energy Market Authority of Singapore Act 2001;

“market rules” has the meaning given by section 2(1) of the Electricity Act 2001;

“specified open cycle gas turbine” means any of the following open cycle gas turbines located at 16 Jurong Pier Road, Singapore 619175:

(a) the open cycle gas turbine with the identification number JUR GT1;

(b) the open cycle gas turbine with the identification number JUR GT2;

“specified period” means the period from 21 July 2023 to 31 December 2025 (both dates inclusive);

“specified steam plant” means any of the following steam plants located at 3 Seraya Avenue, Singapore 628209:

(a) the steam plant with the identification number SER G2;

(b) the steam plant with the identification number SER G3.

Exemption

3.—(1)  Sub‑paragraph (2) applies if —

(a) the Energy Market Authority of Singapore has issued to YTL PowerSeraya Pte. Limited a dispatch instruction for a specified open cycle gas turbine; and

(b) YTL PowerSeraya Pte. Limited operates the specified open cycle gas turbine (called in this paragraph the activated specified open cycle gas turbine) in accordance with the dispatch instruction.

(2)  YTL PowerSeraya Pte. Limited is, in respect of the operation of the activated specified open cycle gas turbine for, or for purposes connected with the production of electricity, exempt from section 12(1) of the Act but only in relation to regulation 4(1) of, read with paragraph 1(q) of the Schedule to, the Environmental Protection and Management (Air Impurities) Regulations (Rg 8) —

(a) for the specified period; but

(b) only if the operation of the activated specified open cycle gas turbine does not result in the emission of oxides of nitrogen of a concentration that before admixture with air, smoke or other gases, exceeds 700 mg/Nm³ expressed as nitrogen dioxide.

(3)  Sub‑paragraph (4) applies if —

(a) the Energy Market Authority of Singapore has issued to YTL PowerSeraya Pte. Limited a dispatch instruction for a specified steam plant; and

(b) YTL PowerSeraya Pte. Limited operates the specified steam plant (called in this paragraph the activated specified steam plant) in accordance with the dispatch instruction.

(4)  YTL PowerSeraya Pte. Limited is, in respect of the operation of the activated specified steam plant for, or for purposes connected with the production of electricity, exempt from section 12(1) of the Act but only in relation to regulation 4(1) of, read with paragraph 1(q) of the Schedule to, the Environmental Protection and Management (Air Impurities) Regulations —

(a) for the specified period; but

(b) only if the operation of the activated specified steam plant does not result in the emission of oxides of nitrogen of a concentration that before admixture with air, smoke or other gases, exceeds 700 mg/Nm³ expressed as nitrogen dioxide.
