(PacificLight Power Pte. Ltd. — Exemption)
Order 2025
In exercise of the powers conferred by section 75 of the Environmental Protection and Management Act 1999, the National Environment Agency makes the following Order:
Citation and commencement
1.  This Order is the Environmental Protection and Management (PacificLight Power Pte. Ltd. — Exemption) Order 2025 and comes into operation on 7 May 2025.
Definitions
2.  In this Order —
“aggregate exceedance duration”, in relation to any specified 12‑month period, means the aggregate duration of occasions during the prescribed sessions in that specified 12-month period on which the noise levels emitted from the relevant premises exceed the permissible noise levels when both the Combined Cycle Gas Turbines and the Open Cycle Gas Turbines are in operation in the relevant premises;
“PacificLight Power Pte. Ltd.” means the company incorporated under the Companies Act 1967 as PacificLight Power Pte. Ltd. (UEN 199901043R);
“permissible noise levels” means the maximum permissible noise levels prescribed in regulation 3(1)(b) (read with regulation 3(2) and (3)) of the Regulations;
“prescribed session” means any of the following:
(a)between 7 p.m. and 11.59 p.m. (both times inclusive) of any day;
(b)between 12 a.m. and 6.59 a.m. (both times inclusive) of any day;
“Regulations” means the Environmental Protection and Management (Boundary Noise Limits for Factory Premises) Regulations (Rg 1);
“relevant premises” means the factory premises occupied by PacificLight Power Pte. Ltd. and located at 47 Jurong Island Highway, Singapore 627626;
“specified 12-month period” means the period starting from 7 May 2025 and ending on 6 May 2026 (both dates inclusive) and each subsequent period of 12 months starting on 7 May of a year and ending on 6 May of the succeeding year (both dates inclusive).
Exemption
3.—(1)  PacificLight Power Pte. Ltd. is exempt from regulation 3(1)(b) of the Regulations in respect of the relevant premises during each prescribed session.
(2)  The exemption in sub-paragraph (1) ceases to apply immediately after the occurrence of any of the following:
(a)if the Combined Cycle Gas Turbines are in operation, but the Open Cycle Gas Turbines are not in operation, in the relevant premises — the noise level emitted from the relevant premises, measured over any period of 5 minutes during a prescribed session at any point at or about ground level along a boundary of the relevant premises set out in the first column of Part 1 of the Schedule, exceeds the maximum boundary noise level set out for the prescribed session in the second column of Part 1 of the Schedule (read with sub‑paragraph (3)) corresponding to that boundary;
(b)if both the Combined Cycle Gas Turbines and the Open Cycle Gas Turbines are in operation in the relevant premises — the noise level emitted from the relevant premises, measured over any period of 5 minutes during a prescribed session at any point at or about ground level along a boundary of the relevant premises set out in the first column of Part 2 of the Schedule, exceeds the maximum boundary noise level set out for the prescribed session in the second column of Part 2 of the Schedule (read with sub‑paragraph (3)) corresponding to that boundary;
(c)the aggregate exceedance duration exceeds 700 hours at any time during a specified 12‑month period.
 
Illustration
 
The relevant specified 12‑month period is 7 May 2025 to 6 May 2026 (both dates inclusive). On 15 March 2026, at 10 p.m., the aggregate exceedance duration exceeds 700 hours. The exemption ceases to apply immediately after 10 p.m. on 15 March 2026.
(3)  If there are other sources of noise affecting the measurement of the noise level emitted from the relevant premises during a prescribed session, the applicable maximum boundary noise level set out in the Schedule for the prescribed session is to be adjusted in accordance with regulation 3(3) of, and the Second Schedule to, the Regulations as if a reference in those provisions to the maximum permissible noise level set out in the First Schedule to the Regulations is a reference to the applicable maximum boundary noise level set out in the Schedule for the prescribed session.
