Regulations 2021
In exercise of the powers conferred by section 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:
PART 1
PRELIMINARY
Citation and commencement
1.  These Regulations are the Environmental Public Health (Registration of Environmental Control Coordinators and Environmental Control Officers) Regulations 2021 and come into operation on 20 July 2021.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“relevant work experience”, in relation to an Environmental Control Officer, means practical experience in any of the following areas of work:
(a)cleaning services;
(b)environmental engineering;
(c)environmental health;
(d)estate management;
(e)pest control;
(f)waste management;
(g)any other area that, in the opinion of the Director‑General, is within the scope of an Environmental Control Officer’s duties under the Act;
“specified construction site” means any construction site to which section 62 of the Act applies;
“specified premises” means any premises or class of premises designated under section 62A(2) of the Act as specified premises.
PART 2
REGISTRATION OF ENVIRONMENTAL
CONTROL COORDINATORS
Application for registration as Environmental Control Coordinator for specified premises
3.—(1)  An individual who wishes to be registered as an Environmental Control Coordinator for any specified premises must apply to the Director‑General for the registration in accordance with this regulation.

(2)  An application for registration as an Environmental Control Coordinator for any specified premises must —
(a)be made to the Director‑General in the form and manner that the Director‑General requires;
(b)be accompanied by the information and documents that the Director‑General requires; and
(c)be accompanied by the relevant fee specified in the Schedule.

Registration as Environmental Control Coordinator for specified premises
4.—(1)  The Director‑General may, subject to any condition that the Director‑General thinks fit to impose, register an applicant mentioned in regulation 3 as an Environmental Control Coordinator for any specified premises if the Director‑General is satisfied that —
(a)the applicant —
(i)has been certified under the Workplace Literacy and Numeracy framework to have a proficiency level of at least 5 in the areas of reading, listening, speaking and writing; or
(ii)has such other qualifications and practical experience that renders the applicant competent to act as an Environmental Control Coordinator for any specified premises;

(b)the applicant has, within 5 years before the date on which the application is made, attended and passed any training courses specified by the Director-General for the purpose of the registration; and

(c)the applicant is of good character and reputation.

(2)  When an individual is registered as an Environmental Control Coordinator for any specified premises, the Director‑General must issue to the individual, in the form and manner the Director‑General determines, a certificate of registration that states —
(a)the full name of the individual; and
(b)the unique registration number assigned to the individual for the registration.

(3)  The registration of an Environmental Control Coordinator for any specified premises is valid for a period of 3 years.

Application for renewal of registration as Environmental Control Coordinator for specified premises
5.—(1)  An Environmental Control Coordinator for any specified premises who wishes to renew his or her registration as such must apply to the Director‑General for the renewal of the registration before the registration expires, in accordance with this regulation.

(2)  An application under paragraph (1) must —
(a)be made to the Director‑General in the form and manner that the Director‑General requires;
(b)be accompanied by the information and documents that the Director‑General requires; and
(c)be accompanied by the relevant fee specified in the Schedule.

Renewal of registration as Environmental Control Coordinator for specified premises
6.—(1)  After receiving an application under regulation 5 from an Environmental Control Coordinator for any specified premises (called in this regulation the applicant), the Director‑General may, subject to any condition that the Director‑General thinks fit to impose, renew the registration of the applicant as an Environmental Control Coordinator for any specified premises if the Director‑General is satisfied that —
(a)the applicant has, within 5 years before the date on which the application is made, passed any assessments specified by the Director-General for the purpose of the renewal of the registration; and

(b)the applicant is of good character and reputation.

(2)  When the registration of an individual as an Environmental Control Coordinator for any specified premises is renewed, the Director‑General must issue to the individual, in the form and manner the Director‑General determines, a certificate of registration that states —
(a)the full name of the individual; and
(b)the unique registration number assigned to the individual for the renewed registration.

PART 3
REGISTRATION OF ENVIRONMENTAL
CONTROL OFFICERS
Application for registration as Environmental Control Officer
7.—(1)  An individual who wishes to be registered as an Environmental Control Officer for specified premises or for specified construction sites must apply to the Director‑General for the registration in accordance with this regulation.
(2)  An application for registration as an Environmental Control Officer must —
(a)be made to the Director‑General in the form and manner that the Director‑General requires;
(b)be accompanied by the information and documents that the Director‑General requires; and
(c)be accompanied by the relevant fee specified in the Schedule.
Registration as Environmental Control Officer
8.—(1)  The Director‑General may, subject to any condition that the Director‑General thinks fit to impose, register an applicant mentioned in regulation 7 as an Environmental Control Officer for specified premises or for specified construction sites if the Director‑General is satisfied that —
(a)the applicant —
(i)has been certified under the Workplace Literacy and Numeracy framework to have a proficiency level of at least 7 in the areas of reading, listening, numeracy, speaking and writing;
(ii)has at least 2 years of relevant work experience, and has been certified under the Workplace Literacy and Numeracy framework to have a proficiency level of at least 6 in the areas of reading, listening, numeracy, speaking and writing; or
(iii)has such other qualifications and practical experience that renders the applicant competent to act as an Environmental Control Officer;
(b)the applicant has attended and passed —
(i)in the case where the application is for registration as an Environmental Control Officer for specified premises — such training courses specified by the Director‑General for the purpose of the registration; or

(ii)in the case where the application is for registration as an Environmental Control Officer for specified construction sites — within 5 years before the date on which the application is made, such training courses specified by the Director‑General for the purpose of the registration; and

(c)the applicant is of good character and reputation.
(2)  When an individual is registered as an Environmental Control Officer, the Director‑General must issue to the individual, in the form and manner the Director‑General determines, a certificate of registration that states —
(a)the full name of the individual;
(b)the unique registration number assigned to the individual for the registration; and
(c)whether the individual is authorised to act as an Environmental Control Officer for —
(i)any specified construction site; or
(ii)any specified premises.
(3)  The registration of an Environmental Control Officer is valid for a period of 3 years.
Application for renewal of registration as Environmental Control Officer
9.—(1)  An Environmental Control Officer who wishes to renew his or her registration as such must apply to the Director‑General for the renewal of the registration before the registration expires, in accordance with this regulation.
(2)  An application under paragraph (1) must —
(a)be made to the Director‑General in the form and manner that the Director‑General requires;
(b)be accompanied by the information and documents that the Director‑General requires; and
(c)be accompanied by the relevant fee specified in the Schedule.
Renewal of registration as Environmental Control Officer
10.—(1)  After receiving an application under regulation 9 from an Environmental Control Officer (called in this regulation the applicant), the Director‑General may, subject to any condition that the Director‑General thinks fit to impose, renew the registration of the applicant as an Environmental Control Officer if the Director‑General is satisfied that —
(a)the applicant has passed —
(i)in the case where the applicant is registered as an Environmental Control Officer for specified premises — such assessments specified by the Director‑General for the purpose of the renewal of the registration; or

(ii)in the case where the applicant is registered as an Environmental Control Officer for specified construction sites — within 5 years before the date on which the application is made, such assessments specified by the Director‑General for the purpose of the renewal of the registration;

(b)the applicant has, within 3 years before the date on which the application is made, successfully completed the courses or training relating to the duties of an Environmental Control Officer specified by the Director-General for the purpose of the renewal of the registration; and

(c)the applicant is of good character and reputation.
(2)  When the registration of an individual as an Environmental Control Officer is renewed, the Director‑General must issue to the individual, in the form and manner the Director‑General determines, a certificate of registration that states —
(a)the full name of the individual;
(b)the unique registration number assigned to the individual for the renewed registration; and
(c)whether the individual is authorised to act as an Environmental Control Officer for —
(i)any specified construction site; or
(ii)any specified premises.
PART 4
CANCELLATION
Cancellation
11.  The Environmental Public Health (Qualifications of Environmental Control Officers) Notification (N 2) is cancelled.
PART 5
SAVING AND TRANSITIONAL PROVISIONS
Saving and transitional provisions
12.—(1)  Every certificate of registration that is issued under regulation 3(5) of the Environmental Public Health (Registration of Environmental Control Officers) Regulations (Rg 2) before 20 July 2021 and is in force immediately before that date, is to continue in force as if the certificate of registration were issued under regulation 8(2) of these Regulations.
(2)  A certificate of registration mentioned in paragraph (1) that is expressed to continue in force for a definite period ceases to be in force after the expiration of that period unless the registration to which that certificate of registration relates is renewed before its expiry in accordance with these Regulations.
(3)  Any application made under the Environmental Public Health (Registration of Environmental Control Officers) Regulations before 20 July 2021 for the registration or the renewal of the registration of an individual as an Environmental Control Officer authorised to act for any specified construction site, that is still pending on or after that date, is to be treated as if that application were made under regulation 7 or 9 (respectively) of these Regulations.
