Control of Vectors and Pesticides
(Registration of Pesticides and
Vector Repellents) Regulations 2023

In exercise of the powers conferred by section 60 of the Control of Vectors and Pesticides Act 1998, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and commencement

1.  These Regulations are the Control of Vectors and Pesticides (Registration of Pesticides and Vector Repellents) Regulations 2023 and come into operation on 1 September 2023.

Requirements for application for registration

2.—(1)  For the purpose of section 6 of the Act, the form for an application for the registration of a pesticide or vector repellent is the application form provided at the Agency’s official website at https://www.nea.gov.sg.

(2)  For the purpose of section 6(b) of the Act and subject to paragraph (3), the application mentioned in paragraph (1) must be accompanied by the following particulars, information and documents:

(a) where the applicant is an entity registered under an applicable Act —

(i) the business profile of the applicant that is made available on the Internet website of the Accounting and Corporate Regulatory Authority at https://www.bizfile.gov.sg;

(ii) a copy of the identification document of the authorised representative of the applicant; and

(iii) a copy of the letter of authorisation issued by the applicant to the authorised representative of the applicant authorising him or her to act for the applicant for the purpose of the application;

(b) where the applicant is an individual, a copy of his or her identification document;

(c) where the pesticide or vector repellent has been registered with another authority performing the function of regulating pesticides or vector repellents (whether in Singapore or otherwise), a copy of a certificate or any other document issued by that authority in respect of that registration;

(d) where the pesticide or vector repellent contains any hazardous substance as defined in section 2 of the Environmental Protection and Management Act 1999, a copy of a licence granted under section 22 of that Act to the applicant in respect of the hazardous substance;

(e) a copy of the label proposed to be affixed to or printed on the container or package containing the pesticide or vector repellent, which must comply with the requirements in regulation 4;

(f) data from the manufacturer or any published scientific data relating to —

(i) the nature and composition of the substance or substances that constitute the pesticide or vector repellent; and

(ii) the safety, efficacy and quality of the pesticide or vector repellent.

(3)  The Director-General may require that an application in relation to the pesticide or vector repellent be accompanied by the additional information specified in paragraph (4), if the Director‑General is of the opinion that —

(a) there is cause for concern in relation to the potential for any person to be exposed to a pesticide or vector repellent by way of inhalation, ingestion or skin contact; or

(b) there is cause for concern from toxicity tests or published scientific data in relation to any toxic effect of a pesticide or vector repellent.

(4)  The additional information mentioned in paragraph (3) is any one or more of the following:

(a) the applicant’s knowledge of any harmful effect (such as bodily injury to any individual or damage to any property) of the pesticide or vector repellent, whether by itself or in combination with any other substance;

(b) any recommended procedure for the cleaning of any equipment and protective clothing used in the course of handling the pesticide or vector repellent, including any method to assess the efficacy of the procedure;

(c) any information relating to any by-product likely to be generated due to the combustion of the pesticide or vector repellent;

(d) any procedure to be complied with in the event of any accident during the transport, storage or use of the pesticide or vector repellent, including —

(i) how the pesticide or vector repellent is to be neutralised;

(ii) how any spillage of the pesticide or vector repellent is to be contained;

(iii) how an area, a vehicle or a building is to be decontaminated;

(iv) how any damaged packaging, absorbent or other material is to be disposed of;

(v) how emergency workers and other persons are to be protected; and

(vi) any applicable first aid procedure;

(e) any procedure to be complied with in the case of exposure to the pesticide or vector repellent, to monitor the effect of the exposure;

(f) any first aid procedures to be undertaken in the case of exposure to the pesticide or vector repellent;

(g) any waiting period required before any re-entry to an area, a vehicle or a building that was exposed to the pesticide or vector repellent;

(h) any procedure to be complied with in relation to the cleaning of an area that was exposed to the pesticide or vector repellent (including how and when that area should be cleaned);

(i) any other recommended protective measure to reduce occupational exposure to the pesticide or vector repellent.

(5)  In paragraph (2) —

“applicable Act” means —

(a) the Business Names Registration Act 2014;

(b) the Companies Act 1967;

(c) the Limited Liability Partnerships Act 2005; or

(d) the Limited Partnerships Act 2008;

“identification document” means —

(a) an identity card (as defined in section 2(1) of the National Registration Act 1965);

(b) an employment pass (as mentioned in regulation 2(1)(c) of the Employment of Foreign Manpower (Work Passes) Regulations 2012 (G.N. No. S 569/2012)), excluding a training employment pass;

(c) a re-entry permit (as defined in section 2 of the Immigration Act 1959); or

(d) a work permit (as mentioned in regulation 2(1)(a) of the Employment of Foreign Manpower (Work Passes) Regulations 2012), excluding a training work permit.

Fee for application for registration

3.—(1)  For the purpose of section 6(a) of the Act, the prescribed fee is —

(a) where the application is for the registration of a pesticide — $160; and

(b) where the application is for the registration of a vector repellent — $160.

(2)  Any fee paid under paragraph (1) is not refundable.

Particulars for label for registered pesticide or vector repellent

4.—(1)  For the purpose of section 5(2) of the Act and subject to paragraph (2), the prescribed particulars for a label are the following particulars in English:

(a) the brand and name of the pesticide or vector repellent;

(b) the composition of the pesticide or vector repellent, including —

(i) the name of every active ingredient in the pesticide or vector repellent and the percentage (weight by weight) of the active ingredient in the pesticide or vector repellent; and

(ii) the total percentage (weight by weight) of the inert ingredient or ingredients in the pesticide or vector repellent;

(c) the formulation code of the pesticide or vector repellent as specified in the Schedule;

(d) the hazard classification of the pesticide or vector repellent, according to the World Health Organisation Recommended Classification of Pesticides by Hazard;

(e) the hazard warning statement or symbol applicable to the pesticide or vector repellent, according to the World Health Organisation Recommended Classification of Pesticides by Hazard;

(f) whether the pesticide or vector repellent is for general or restricted use;

(g) the net weight or volume of the pesticide or vector repellent, whichever is applicable;

(h) the vector or vectors that the pesticide is intended to control or the vector repellent is intended to repel;

(i) the date of manufacture of the pesticide or vector repellent;

(j) the expiry date or shelf life of the pesticide or vector repellent;

(k) the residual effective period (if any) of the pesticide or vector repellent after a single application of the pesticide or vector repellent, as the case may be;

(l) any toxicological effect of the pesticide or vector repellent on any organism that is not mentioned in sub‑paragraph (h);

(m) any safety precaution that must be taken when handling the pesticide or vector repellent;

(n) the directions for the use of the pesticide or vector repellent;

(o) the manner of storage and disposal of the pesticide or vector repellent;

(p) any practical treatment statement and medical instruction to be applied in the case of poisoning or suspected poisoning caused by the pesticide or vector repellent;

(q) the name and address of the manufacturer, and the importer, of the pesticide or vector repellent.

(2)   The particulars in paragraph (1)(l), (m), (o) and (p) may, instead of being specified on the label mentioned in paragraph (1), be specified in a leaflet or brochure that is enclosed within or affixed to the container or package of the pesticide or vector repellent.
