Building Maintenance and Strata Management
(Small Management Corporations — Exemption)
Order 2018

In exercise of the powers conferred by section 134(1) of the Building Maintenance and Strata Management Act, the Minister for National Development makes the following Order:

Citation and commencement

1. This Order is the Building Maintenance and Strata Management (Small Management Corporations — Exemption) Order 2018 and comes into operation on 1 February 2019.

Definition

2. In this Order, “small management corporation” means a management corporation constituted for a strata title plan with 10 or fewer lots.

Exemption from section 53(9A) disqualification

3.—(1) An individual who is elected at a general meeting of a small management corporation as a treasurer or secretary of the small management corporation is not ineligible under section 53(9A)(a) of the Act for election or re‑election to office as a chairperson of that small management corporation.

(2) An individual who is elected at a general meeting of a small management corporation as a chairperson or secretary of the small management corporation is not ineligible under section 53(9A)(b) of the Act for election or re‑election to office as a treasurer of that small management corporation.

(3) An individual who is elected at a general meeting of a small management corporation as a chairperson or treasurer of the small management corporation is not ineligible under section 53(9A)(c) of the Act for election or re-election to office as a secretary of that small management corporation.

Exemption from section 53(9B) disqualification

4. An individual in a small management corporation is not ineligible under section 53(9B) of the Act for re-election to office as a treasurer of the small management corporation.

Exemption from section 55(7) disqualification

5.—(1) An individual who is already elected or appointed as the treasurer or secretary of the council of a small management corporation is not ineligible under section 55(7)(a) of the Act for appointment as a chairperson by the council of the small management corporation.

(2) An individual who is already elected or appointed as the chairperson or secretary of the council of a small management corporation is not ineligible under section 55(7)(b)(i) of the Act for appointment as a treasurer by the council of the small management corporation.

(3) An individual who is already elected or appointed as the chairperson or treasurer of the council of a small management corporation is not ineligible under section 55(7)(c) of the Act for appointment as a secretary by the council of the small management corporation.

(4) An individual in a small management corporation is not ineligible under section 55(7)(b)(ii) of the Act for re-appointment as a treasurer of the council of the small management corporation.

Revocation

6. The Building Maintenance and Strata Management (Exempt Treasurers) Order (O 1) is revoked.
