PRELIMINARY
Citation
1.  These Regulations are the Allied Health Professions (Registration and Practising Certificates) Regulations 2013.
PART 2
REGISTRATION OF
ALLIED HEALTH PROFESSIONALS
Credentials Committees
2.—(1)  The Council must appoint a committee, to be known as the Credentials Committee, for each prescribed allied health profession to advise the Council —
(a)whether an applicant for registration under section 21 of the Act should —
(i)be registered with full, restricted, conditional or temporary registration, as the case may be;
(ii)be refused registration; or
(iii)be required to undergo and pass an examination under section 19(2) of the Act; and
(b)where applicable, whether the registration should be subject to any condition or restriction.
(2)  Every Credentials Committee must consist of at least one member of the Council and any number of other persons that the Council may determine.
(3)  The Council must appoint a member of each Credentials Committee as the Chairperson of that Committee.
(4)  The members of the Credentials Committee are to hold office for a period of 3 years and are eligible for re‑appointment for further terms not exceeding 3 years each.
Application for registration
3.—(1)  For the purposes of section 21(1)(a) of the Act, an application for registration as an allied health professional must be accompanied by the following:
(a)unless dispensed with by the Council —
(i)a certified true copy of the diploma or degree entitling the applicant to be registered;
(ii)a transcript of the diploma or degree mentioned in sub‑paragraph (i) issued by the institution of higher learning that conferred the diploma or degree;
(iii)a certified true copy of the applicant’s identity card or passport;
(iv)a recent passport size photograph of the applicant;
(v)the details of employment in Singapore or offer of employment to work in Singapore;
(vi)where applicable, details in writing of the applicant’s professional practice experience in his or her prescribed allied health profession, including details of the nature, duration and extent of the experience in any form that the Council may require; and
(vii)where the applicant is registered in his or her prescribed allied health profession in a foreign country, a certificate from the registration body of that country stating, as at the date of issue of the certificate —
(A)that the applicant is a registered person in his or her prescribed allied health profession in that country;
(B)the details of any complaint or disciplinary proceeding that has been taken or is pending against him or her in that country;
(C)the specific details of any condition or undertaking that apply to the applicant’s registration in that country;
(D)the specific details of any suspension or cancellation of the applicant’s registration in that country; and
(E)any other information recorded in the register pertaining to the applicant’s registration in that country;
(b)any other information, statement or document (including any statutory declaration) required by the Council.
(2)  Any document referred to in paragraph (1) which is not in English must be accompanied by a certified translation in English.
Prescribed qualifications, knowledge, etc., for conditional registration
4.—(1)  For the purposes of section 18(1)(a) of the Act, the prescribed qualifications in the respective prescribed allied health professions conferred by an institution of higher learning in Singapore are set out in Division 1 of the corresponding Parts of the First Schedule.
(2)  For the purposes of section 18(1)(b) of the Act, the prescribed qualifications in the respective prescribed allied health professions conferred by an institution of higher learning outside Singapore are set out in Division 2 of the corresponding Parts of the First Schedule.
(3)  For the purposes of section 18(2) of the Act, the respective examinations that the Council may require a person to undergo and pass for the purpose of satisfying itself that the qualification held by that person is not lower in standing than the qualification prescribed under section 18(1)(a) or (b) of the Act are set out in the corresponding Parts of the Second Schedule.
(4)  Unless the Council otherwise allows, a person required to undergo and pass the examination mentioned in paragraph (3) is entitled to only 2 attempts at the examination.
Time limit for renewal of temporary registration
5.  A temporary registration in a prescribed allied health profession may not be renewed under section 19(3) of the Act if the application for renewal of the temporary registration is made later than one month before the expiry of the previous temporary registration.
Application to use, exhibit, etc., additional qualification
6.—(1)  A registered allied health professional may apply to the Council for approval to use or exhibit or publish in any card, letter, stationery, nameplate, signboard, placard, circular, handbill or any notice displayed at the premises used by him or her for the practice of any prescribed allied health profession any qualification other than the qualifications which are entered against his or her name in the appropriate register.
(2)  An application mentioned in paragraph (1) must be made in the manner specified by the Council and be accompanied by the appropriate fee specified in the Third Schedule.
Application for restoration of registration
7.—(1)  For the purposes of section 27 of the Act, an application to restore to the appropriate register the name of a person whose name has been removed from the register under section 26(1)(a), (b) or (c) of the Act must —
(a)be made in writing, addressed to the Registrar and signed by the applicant;
(b)state the grounds on which the application is made;
(c)be accompanied by a statutory declaration in the form set out in the Fourth Schedule and any other information, statements or documents required by the Council; and
(d)be accompanied by the appropriate fee specified in the Third Schedule.
(2)  Without limiting paragraph (1)(c), the Council may require the applicant to furnish proof that he or she has adequate clinical knowledge and skills to practise in his or her prescribed allied health profession and for that purpose may require the applicant to attend the courses of instruction that the Council may determine.
(3)  The Council may, if it thinks fit in any case or class of cases, dispense with any requirement or requirements in paragraphs (1) and (2).
(4)  The Council may, if it thinks fit, require further evidence or information from an applicant under this regulation.
Consideration by Council for restoration
8.—(1)  On receipt of an application mentioned in regulation 7, the Registrar must refer the application to the Council for consideration.
(2)  Except with the permission of the Council, the applicant must not appear before the Council on the consideration of the application.
(3)  The Council must consider the application in private and may, if it thinks fit, adjourn the consideration to a future date.
(4)  If the Council —
(a)directs the restoration of the applicant’s name to the register under section 27(1)(a) of the Act; or
(b)registers the applicant as an allied health professional with restricted, conditional or temporary registration under section 27(1)(b) of the Act,
the Registrar must send notice thereof to the authorities or persons (if any) to whom he or she has previously given notice of removal.
PART 3
CERTIFICATES OF REGISTRATION
Display of certificate of registration
9.—(1)  Where a person —
(a)has had his or her name removed from the appropriate register under section 15(1)(c) or (2), 26(1), 37(1)(c) or (e), 49(1)(g)(i) or (iii), 53(2)(a) or (c), 54(1)(a), (3)(a) or (8) or 58(1)(b) or (2) of the Act; or
(b)has had his or her registration suspended under section 37(1)(d), 49(1)(g)(ii), 53(2)(b), 54(1)(b) or (8), 58(1)(a) or (3), 61(1)(a) or 63(1)(c) of the Act,
he or she must immediately remove every original or copy of his or her certificate of registration which had been displayed at each place of his or her practice as an allied health professional.
(2)  Any person who fails to comply with paragraph (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.
Duplicate of certificate of registration
10.—(1)  Where a certificate of registration issued by the Council under section 22 of the Act has been lost, destroyed, defaced or obliterated such that any particulars in the certificate are illegible, the holder of the certificate must immediately apply to the Registrar for a duplicate of the certificate of registration.
(2)  Subject to paragraphs (4) and (5), the Registrar must, on payment of the appropriate fee specified in the Third Schedule, if he or she is satisfied that a certificate of registration has been lost, destroyed, defaced or obliterated, issue a duplicate of the certificate to the holder of the original certificate.
(3)  A duplicate of a certificate of registration has the same effect as the original.
(4)  In the case of a certificate of registration which has been defaced or obliterated, no duplicate of the certificate is to be issued unless the original certificate is returned to the Registrar.
(5)  In the case of a certificate of registration which has been lost or destroyed, no duplicate of the certificate is to be issued unless the holder of that certificate makes a statutory declaration of the loss or destruction and furnishes it to the Registrar.
(6)  Where any original certificate of registration is found after any duplicate of the certificate is issued under this regulation, the holder of the certificate must immediately return the duplicate to the Registrar for cancellation.
(7)  Any person who fails to comply with paragraph (6) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.
Application for certified true copy of certificate of registration
11.  An application for a certified true copy of a certificate of registration must be made in any form that the Council may require and be accompanied by the appropriate fee specified in the Third Schedule.
PART 4
PRACTISING CERTIFICATES
Practising certificate
12.—(1)  For the purposes of section 23(3) of the Act, a practising certificate is to be granted for a period not exceeding 5 years from the date of issue or renewal of the practising certificate.
(2)  A registered allied health professional must, at the time of an application for the grant or a renewal of a practising certificate, pay to the Council for the period that the practising certificate is to be valid, the practising fee specified in the Third Schedule.
(3)  The holder of a practising certificate must make available his or her original practising certificate when requested to do so in his or her practice as an allied health professional.
(4)  Any person who fails to comply with paragraph (3) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.
Duplicate of practising certificate
13.—(1)  Where a practising certificate has been lost, destroyed, defaced or obliterated such that any particulars in the certificate are illegible, the holder of the certificate must immediately apply to the Registrar for a duplicate of the practising certificate.
(2)  Subject to paragraphs (4) and (5), the Registrar must, on payment of the appropriate fee specified in the Third Schedule, if he or she is satisfied that a practising certificate has been lost, destroyed, defaced or obliterated, issue a duplicate of the certificate to the holder of the original certificate.
(3)  A duplicate of a practising certificate has the same effect as the original.
(4)  In the case of a practising certificate which has been defaced or obliterated, no duplicate of the certificate is to be issued unless the original certificate is returned to the Registrar.
(5)  In the case of a practising certificate which has been lost or destroyed, no duplicate of the certificate is to be issued unless the holder of the certificate makes a statutory declaration of the loss or destruction and furnishes it to the Registrar.
(6)  Where any original practising certificate is found after any duplicate of the certificate is issued under this regulation, the holder of the certificate must immediately return the duplicate to the Registrar for cancellation.
(7)  Any person who fails to comply with paragraph (6) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.
Application for certified true copy of practising certificate
14.  An application for a certified true copy of a practising certificate must be made in any form that the Council may require and be accompanied by the appropriate fee specified in the Third Schedule.
PART 5
GENERAL
Certificate of good standing
15.  The Council may, upon the application made by a registered allied health professional in any form that the Council may require and accompanied by the appropriate fee specified in the Third Schedule, issue to the registered allied health professional a certificate of good standing stating that on the date of its issue, that allied health professional is a registered allied health professional and that no proceedings under the Act have been taken or are pending against him or her.
Disclosure of information
16.  The Registrar may disclose any information in any register to any public officer in a ministry or department of the Government or any officer of a statutory board, if the Registrar is satisfied that the disclosure is necessary to enable the ministry, department or statutory board (as the case may be) to perform its public duty or discharge its functions, or if the disclosure is in the interest of public safety.
Fees
17.—(1)  The fees specified in the Third Schedule are payable in respect of the matters specified in that Schedule.
(2)  The Council may waive, remit or refund, in whole or in part, any fee payable under these Regulations in any particular case or class of cases.
Prescribed date for saving and transitional provisions
18.  For the purposes of section 76(1) of the Act, the prescribed date until which any person who, immediately before 15 April 2013, was practising any prescribed allied health profession is deemed to be a duly qualified allied health professional in that profession (unless he or she becomes registered under section 16, 17, 18 or 19 of the Act in respect of that profession or his or her application for registration is refused or withdrawn) is 14 April 2014.
