The Cabinet:
− Having reviewed the Constitution;
− Federal Law No. (1) of 1972 Regarding the Competences of Ministries and the Powers of Ministers, as amended;
− Federal Decree by Law No. (26) of 2019 Regarding Public Finance, as amended;
− Cabinet Resolution No. (30) of 2021 Regarding the Fees for Services Provided by the Ministry of Climate Change and Environment; and
− Upon the proposal of the Minister of Finance and the approval of the Cabinet;
Hereby resolves as follows:
Article (1) Definitions
For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise:
State: The United Arab Emirates.
Ministry: The Ministry of Climate Change and Environment.
Minister: The Minister of Climate Change and Environment.
Article (2) Service Fees
Fees shall be collected for the services provided by the Ministry, as set out in the Schedule attached to this Resolution, at the rates indicated therein.
Article (3) Exemptions
1. Requests from research centers and laboratories shall be exempt from import, export, and release permit fees for samples imported for research, reference, and diagnostic purposes. Research and agricultural extension samples referred to in this Resolution shall also be exempted from laboratory analysis fees.
2. Small projects receiving federal or local government support shall be exempted from the service fees referred to in this Resolution.
3. Agricultural and animal consignments of national or Omani origin sent to the State from the Sultanate of Oman by UAE citizens shall be exempted from the fees referred to in this Resolution related to agricultural and veterinary quarantine services, provided that the incoming consignments comply with the applicable agricultural and veterinary quarantine procedures at the State’s entry points. This exemption applies to the following consignments: sheep, cattle, camels, vegetables, fruits, green and dry fodder, field crops, dates, and seedlings.
Article (4) Amendment of Fees
The Cabinet shall be competent to introduce any amendments to the fees listed in this Resolution, whether by addition, deletion, or modification.
Article (5) Fee Collection
1. Fees stipulated in this Resolution shall be collected by the methods determined by the Ministry of Finance.
2. For the purposes of fee collection under this Resolution, a part of a day shall be considered a full day; a part of a year shall be considered a full year, and a fraction of a ton shall be considered a full ton.
3. Licensing fees referred to in this Resolution shall be due from the date of application submission, whereas renewal fees shall be due from the day following the expiration of the license.
Article (6) Executive Resolutions
The Minister shall issue the necessary resolutions for the implementation of the provisions of this Resolution.
Article (7) Repeals
Cabinet Resolution No. (30) of 2021 Regarding the Fees for Services Provided by the Ministry of Climate Change and Environment is hereby repealed, as well as any provision that contradicts or conflicts with the provisions of this Resolution.
Article (8) Publication and Entry into Force
This Resolution shall be published in the Official Gazette and shall enter into force on the day following the date of its publication.
