The Cabinet,
− Having reviewed the Constitution,
− Federal Law No. (1) of 1972 Regarding the Competences of Ministries and Powers of Ministers, as amended,
− Federal Decree by Law No. (26) of 2019 Regarding Public Finance, as amended,
− Federal Decree by Law No. (48) of 2021 Regarding Higher Education,
− Cabinet Resolution No. (56) of 2021 Regarding the Service Fees Provided by the Ministry of Education,
− Cabinet Resolution No. (106) of 2024 Regarding the Approval of the National Qualifications Framework, and
− Upon the proposal of the Minister of Finance and the approval of the Cabinet,
Hereby resolves as follows:

Article (1) Definitions

For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise:
State: The United Arab Emirates.
Ministry: The Ministry of Higher Education and Scientific Research.
Minister: The Minister of Higher Education and Scientific Research.
National Qualifications Froramewk: The National Qualifications Framework approved by Cabinet Resolution No. (106) of 2024, or any Resolution that supersedes it.
Higher Education Institutions: Governmental and private higher education institutions in the State that offer study programs accredited by the Ministry for the purpose of awarding an academic or professional degree in accordance with the provisions of Federal Decree by Law No. (48) of 2021 Regarding Higher Education.
Technical and Vocational Education and Training (TVET) Institutions: Governmental or private educational or training institutions in the State that offer professional and technical programs or qualifications accredited by the Ministry in accordance with the levels and titles stipulated in the National Qualifications Framework in the State.
Training Institutes / Training Centers: Institutions that provide training services and courses in the State in accordance with the activities licensed by the Ministry.

Article (2) Service Fees

The fees specified for each of the services provided by the Ministry and listed in the Schedule attached to this Resolution shall be collected.

Article (3) Administrative Fines

1. Administrative fines shall be imposed for the violations prescribed in the Schedule below, as indicated against each of them:
    a. Violations related to higher education institutions, training institutes, and training centers:

Changing the activity headquarters or moving to another building without prior approval from the Ministry and in violation of public safety requirements.

Practicing an activity without obtaining a license from the Ministry and the competent authority.

Appointing lecturers or seeking the assistance of technicians, consultants, or lecturers without prior approval from the Ministry.

Failure to pay employees’ salaries.

Assigning the teaching of a subject to an unqualified person or lecturer.

Failure to adhere to the course fees approved by the Ministry.

7

Advertising without obtaining a prior license, or after the expiry of the license term, or in violation of the advertisement conditions.

Issuing magazines or bulletins without prior approval from the Ministry.

Failure to renew the license within thirty days after the expiry of its term.

    b.    Violations related to accredited Technical and Vocational Education and Training (TVET) institutions:

Failure of the accredited Technical and Vocational Education and Training (TVET) institution to comply with the standards and controls issued by the Ministry.

Continuation of an accredited Technical and Vocational Education and Training (TVET) institution in offering professional programs or qualifications after the expiry of its accreditation from the Ministry.

2. The value of the administrative fine shall be doubled upon repetition of the same violation within one year from the date of committing the previous violation, provided that it shall not exceed AED (20,000) twenty thousand dirhams. In the event of repeating the violation for the third time, the license shall be revoked.

Article (4) Grievance

Any interested party may submit a written grievance to the Ministry against any administrative fine referred to in Article (3) of this Resolution that has been imposed upon them, within (15) fifteen days from the date of being notified of the decision subject to the grievance, provided that the grievance shall be reasoned and accompanied by all supporting documents. The grievance shall be decided upon within (30) thirty days from the date of its submission, in accordance with the procedures in force at the Ministry.

Article (5) Amendment of Fees and Administrative Fines

The Cabinet shall have the competence to make any amendments to the fees and administrative fines set forth in this Resolution, whether by addition, deletion, or modification.

Article (6) Collection of Fees and Administrative Fines

The fees and administrative fines stipulated in this Resolution shall be collected through the means determined by the Ministry of Finance.

Article (7) Executive Resolutions

The Minister shall issue the necessary resolutions for the implementation of the provisions of this Resolution.

Article (8) Repeals

Any provision that contradicts or conflicts with the provisions of this Resolution is hereby repealed.

Article (9) Publication and Entry into Force

This Resolution shall be published in the Official Gazette and shall enter into force on the day following the date of its publication.
