Article (1) Definitions

For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise:
State: The United Arab Emirates
Ministry: The Ministry of Education (MOE).
Minister: The Minister of Education.
Professional License: A permit issued by the Ministry whereby its holder is permitted to practice professions related to the education sector in the State.
Qualifications: Documents that delineate the level of learning outcomes acquired by an individual, enabling the performance of specific tasks or duties, in accordance with the approved classifications, definitions, and standards applicable to various occupations and specializations. Such qualifications are issued as recognized certificates in general or vocational education that assist the holder in employment, promotion, or the pursuit of further education.
 

Article (2) Service Fees

The fees assigned to each service provided by the Ministry, as detailed in the schedule annexed hereto, shall be charged.

Article (3) Administrative Fines

a. In respect of the violations listed in the schedule below, administrative fines prescribed thereto shall be imposed.

First: Violations Related to Private Schools

b. The Minister may issue a resolution to revoke the license of any nursery if it fails to renew its license for more than 90 days.

Fourth: Violations Related to Educational Institutions Accredited for Offering Professional, Vocational, and Technical Qualifications

c. The administrative fine shall be doubled in case of recidivism within one year from the date of the previous violation, provided that the fine does not exceed (AED 20,000) twenty thousand dirhams. In case of a third-time violation, the accreditation shall be revoked.

Article (4) Grievance

Any interested party may file a written grievance to the Ministry against the administrative fines stipulated in Article (3) hereof, which are imposed thereon within a period not exceeding fifteen (15) days as of the date of notification of the decision subject of grievance. Such grievance shall be justified, and all supporting documents shall be attached. The grievance shall be decided upon within thirty (30) days as of the date of submission pursuant to procedures in force at the Ministry.

Article (5) Amendment of Administrative Fees and Fines

The Cabinet shall have the exclusive authority to make any amendment to the administrative fees and fines stipulated in this Resolution by addition, deletion, or modification.

Article (6) Final Provisions

1. The fees and fines determined in this Resolution shall be collected using the methods determined by the Ministry of Finance.
2. For the purposes of collecting the fees and administrative fines specified in Article (2) and (3) of this Resolution, a part of a day shall be deemed a full day, and a part of a month shall be deemed a full month.
3. The fees collected shall be deposited into the State's unified treasury account.
4. The revenues generated from the professional licensing service fees stipulated in this Resolution shall be allocated to cover the operational costs associated with professional licensing accreditation, provided that the annual financial costs shall not exceed the total revenues collected.
5. The Ministry shall coordinate with the Ministry of Finance to determine the financial appropriations required to fund the EmSAT testing programs.
6. UAE national students (and those treated as such) shall be exempt from the Emirates Standardized Test (EmSAT) fees for the full test package for the first attempt only. Financially disadvantaged students may also be exempted upon retake, in accordance with the criteria agreed upon between the Ministry of Education and the Ministry of Finance.
7. Children of frontline professionals, whether UAE nationals or residents, shall be exempt from the Emirates Standardized Test (EmSAT) fees for the full test package, for both the first attempt and any subsequent retakes, in accordance with the lists approved by the Frontline Heroes Office for the years 2020–2021.
8. Non-profit private educational institutions shall be exempt from the licensing, renewal, and data amendment fees prescribed under this Resolution.
9. All general certificates and their original forms shall be exempt from the attestation fees referred to in Article (2) (Seventh: Miscellaneous Services) of this Resolution.

Article (7) Executive Resolutions

The Minister shall issue the resolutions required for the implementation of the provisions

Article (8) Repeals

a. The following resolutions shall hereby be repealed:
    1. Cabinet Resolution No. (9) of 2001 Regarding the Modification and Introduction of Licensing and Violations Fees on Private Educational Institutions;
    2. Cabinet Resolution No. (19) of 2014 Regarding the Introduction of a Fee for the Service of Supervising Students Sent to Study Abroad,
    3. Cabinet Resolution No. (25) of 2015 Regarding the Fees for Services provided by the National Qualifications Authority (NQA);
    4. Cabinet Resolution No. (57) of 2019 Regarding Professional Licensing Fees for Education Sector's Workers in the State; and
    5. Minister of Finance Resolution No. (39) of 2008 Regarding the Amendment and Introduction of Certain Service Fees provided by the Ministry of Education.
b. Any provision that contradicts or conflicts with this Resolution is hereby repealed.
 

Article (9) Publication and Entry into Force

This Resolution shall be published in the Official Gazette and shall enter into force from the day following the date of its publication.
