Although the Claimant’s Skeleton dated 5 December 2022 was served within the Defendant’s application for permission to appeal the Judgment and without permission to do so from the Court, I have considered paragraphs 118 – 191 of that skeleton and in my judgment, each of the Claimant’s Grounds of Appeal has a real prospect of success for the purposes of RDC 44.19 and accordingly I grant the Permission Application.
