a Case Management Conference in this matter
AND UPON
hearing Counsel for the Claimant and Counsel for the Defendant
IT IS HEREBY ORDERED AND DIRECTED THAT:
1 The proceedings are to be stayed until 21 November 2010 for the parties to explore justice by reconciliation through mediation..
2 The Claimant's legal representatives are to notify the
Court
by 21 November 2010 as to whether any settlement has been reached. If any settlement has been reached, the parties are to file a consent order by 21 November 2010 reflecting such settlement.
3 Standard disclosure is to be made by 23 December 2010.
4 Signed statements of witnesses of fact, and hearsay notices where required by
RDC 29.104
, are to be exchanged by 24 February 2011.
5 Unless otherwise ordered, witness statements are to stand as
evidence in chief
of the witness at trial.
6 The Claimant is granted leave for one of its factual witnesses to give evidence by video link from London, United Kingdom.
7 Signed reports of experts:
(a) are to be confined to one expert for each party from each of the following fields of expertise:
(i) quantum;
(ii) architectural performance;
in each case addressing a list of issues to be agreed by the parties by 6 January 2011.
(b) Are to be exchanged simultaneously by 7 April 2011.
8 Meetings of experts:
(a) The meetings of experts are to take place by 21 April 2011.
(b) The joint memorandum of experts is to be completed by 28 April 2011.
(c) Any short supplemental experts' reports are to be exchanged simultaneously by 12 May 2011.
9 Preparation of trial bundles to be completed in accordance with
Part 35
of the Rules by not later than 4 weeks before trial.
10 The trial is listed to commence on 19 June 2011 with an estimated duration of 5 days.
11 The progress monitoring date is 26 May 2011. Each party is to file and serve a completed Progress Monitoring Sheet at least 3 days before the progress monitoring date.
12 Each party is to file and serve a completed pre-trial checklist not later than 3 weeks before the date fixed for trial.
13 A pre-trial review is to take place on 5 June 2011.
14 Costs in the case.
15 Liberty to apply.
