“Request”
) pursuant to r. 40.17 of the Rules of the DIFC Court (the
“RDC”
)

the Claimants having filed a Notice of Commencement of Assessment on 28 July 2021 (the
“NOC”
)
AND UPON
the Defendant’s failure to file its Points of Dispute, pursuant to RDC r. 40.15, within 21 days from the date the Claimants served the Defendant with their NOC
AND UPON
considering the Judgment of Justice Lord Angus Glennie dated 17 June 2021
AND UPON
reviewing all other relevant case documents filed in this matter
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Defendant is ordered to pay the Claimants a total of AED 471,115.42 (the
“Amount”
) within 21 days from the date of this Order, comprising:
(a) AED 470,527.82 being the amount set out in the Claimants’ NOC; and
(b) USD 160, in costs payable to the Claimants for the commencement of detailed assessment proceedings, pursuant to RDC r. 40.22.
3. In the event the Defendant does not pay the Amount within 21 days from the date of this Order, interest, pursuant to Practice Direction No. 4 of 2017 (Interest on Judgments) will accrue on the Amount from 28 October 2021 until the date of full payment.
