CONSENT ORDER
UPON
reviewing the Consent dated 21 June 2023 (the “Order”)
AND UPON
the parties agreeing to the terms of this Consent Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. Paragraphs 12 and 13 of Schedule 1 of the Order shall be amended as follows:
"12. The parties’ experts shall pursuant to RDC 31.58 meet by telephone conference, video conference, or in person, to discuss their evidence by no later than 4pm on 1 September 2023.
13. The parties’ experts shall, pursuant to RDC 31.63 following their meeting and by 13 September 2023, draw up and sign a joint memorandum recording each of the matters set out at RDC 31.63, sub-paragraphs (1) – (4)."
2. The parties shall agree on an Agreed List of Issues for the Joint Memorandum referred to in paragraph 13 of the Order.
3. The Claimant shall provide to the Defendant a draft Agreed List of Issues for the Joint Memorandum by no later than
4pm on 25 August 2023
.
4. The Defendant shall provide to the Claimant any proposed amendments to the draft Agreed List of Issues for the Joint Memorandum by no later than
4pm on 29 August 2023
.
5. The Agreed List of Issues for the Joint Memorandum must be agreed by no later than
4pm on 30 August 2023
. If there is no agreement in respect of certain proposed Issues, then in accordance with RDC 31.60, the experts are at liberty to agree between themselves how to address these Issues in the Joint Memorandum, while highlighting that such Issues have not been agreed.
6. There shall be no order as to costs.
