the Claimants’ application dated 23 June 2022 for an interim injunction and freezing order (Application CFI-043-2022/1) (the “Application”)
AND UPON
the ex parte hearing before HH Justice Robert French on 27 June 2022
AND UPON
the order of HH Justice Robert French dated 29 June 2022 granting, inter alia, an interim injunction and a freezing order against the Defendant (the
“Order”
)
AND UPON
the Claimants’ application for an order continuing the Order until satisfaction of judgment or further order of the Court
AND UPON
the inter partes hearing on 6 July 2022 before Justice Sir Jeremy Cooke
AND UPON
hearing counsel for the parties
IT IS HEREBY ORDERED THAT:
1. The Return Date directed by paragraph 3 of the Order is adjourned to
8 September 2022,
time estimate 1 day.
2. The interim injunction granted at paragraph 4 of the Order and the freezing order granted at paragraphs 5 to 7 and 10 of the Order shall be continued until the Return Date or further order of the Court on the terms set out in the Order.
3. The Defendant shall file and serve any evidence in response to the Application by
4pm on 27 July 2022.
4. The Claimants shall file and serve by
4pm on 26 August 2022:
(1) Any evidence in reply for the Application; and
(2) Any evidence in response to any application the Defendant may make disputing the jurisdiction of the DIFC Courts.
5. The Defendant shall file and serve any evidence in reply on jurisdiction by
4pm on 2 September 2022.
6. The Defendant shall pay the Claimants’ costs of the hearing on 6 July 2022, summarily assessed in the sum of US$25,000, such costs to be paid by
4pm on 3 August 2022.
7. Save as set out in paragraph 6, costs are reserved.
8. This order shall be served by the Claimants on the Defendant’s legal representatives.
9. Any requirement for personal service shall be dispensed with.
