UPON the Application of the Defendants/Applicants,
AND UPON hearing Counsel for the Defendants/Applicants and Counsel for the Claimants/Respondents
IT IS ORDERED THAT:
1. Pursuant to
Rule 38.13
of the Rules of the
DIFC Courts
, the Claimants/Respondents are to make an interim payment to the Defendants within 14 days of the date of this Order in the amount of AED 200,000 (Two Hundred Thousand Dirhams), being a payment on account of the Defendants' costs prior to a Detailed Assessment.
2. This interim payment is to be recovered on the basis set out at paragraphs 6 and 7 of the Order dated 10 November 2009. In the event that Ms Aldisi and Mr Saleem do not make payment to the Defendants/Applicants of the full AED 200,000 within 14 days any outstanding amount to be paid by the remaining Claimants/Respondents within 21 days of the date of this Order.
3. Any amount due to be paid by the Defendants/Applicants to any of the Claimants/Respondents pursuant to any Order of the
Court
is to be set off against any outstanding amounts under this Order.
4. Costs of this Application to be paid by the Claimants/Respondents in any event.
