IT IS HEREBY ORDERED THAT:
Production of Documents
1. Standard and requested production of documents to be made by each party on or before
23 December 2012
and the Defendant to respond to the Claimants' Request for Clarification/Further Information by the same date.
Witness Statements
2. Signed Statements of Witnesses of Fact, a maximum of four on behalf of each party, to be exchanged by both parties by no later than
24 January 2013
.
Expert Reports
3. The parties shall have leave to call one expert in the field of delay analysis.
4. The Claimants, should they decide to file an Expert Report, shall file and serve any Expert Report not later than
7 February 2013
.
5. The Defendant, should they decide to file an Expert Report, shall file and serve any Expert Report not later than
7 March 2013
.
6. In the event that both parties submit an Expert Report the experts shall meet to discuss their respective reports by
14 March 2013
.
7. In the event that both parties submit Expert Reports, the experts shall submit a Joint Experts' Report setting out the matters on which they are and on which they are not
agreed and this Joint Experts' Report is to be filed and served by
28 March 2013
.
Progress Monitoring Date
8. Parties to send the
Registrar
an agreed Progress Monitoring Information Sheet by
3 April 2013
.
Trial Bundles
9. Agreed Trial Bundles to be completed in accordance with
Part 35
of the RDC and lodged by no later than
28 April 2013
.
Trial
10. The trial of this matter is to take place on
13 May 2013
with an estimated duration of two days with one day held in reserve.
11. Costs in the case.
12. Liberty to apply.
