reviewing the Claimant’s Application Notice No. CFI-024-2021/1 dated 28 March 2021 seeking a Court Order to serve the First Defendant with the Claim Form and Particulars of Claim by alternative methods of service (the
“Application”
)
AND UPON
reviewing the First Witness Statement of Michael Morris dated 23 March 2021 filed in support of the Application
AND PURSUANT TO
Rule 9.3 of the Rules of the DIFC Courts (
“RDC”
)
IT IS HEREBY ORDERED THAT:
1. Pursuant to RDC 9.31, the Claimant is granted permission to serve Claim No. CFI-024-2021 (the "
Claim
") on the Defendants by the alternative method of service set out in paragraphs 2 and 3 of this Order.
2. The Claimant is to serve a copy of the Claim Form, Particulars of Claim and a copy of this Order, by e-mail to the following addresses:
a. “test@test.ae”; and
b. “test@test.ae”.
3. If the Claim is sent to those email addresses, set out in paragraph 2(a) and (b) of this Order (
“Paragraph 2”
), before 4pm on any given day, then the Claim will be considered served on that same day. In the event the Claim is emailed after 4pm, pursuant to Paragraph 2, then the Claim will be considered to be served on the following day.
