reviewing the Claimant’s Application Notice CFI-020-2014/10 dated 14 January 2015 (the “Application”) seeking an extension to the date for filing the Claimant’s Reply to the Defendant’s Defence until after the Case Management Conference (the “CMC”) listed on 2 February 2015 before H.E. Justice Shamlan Al Sawalehi, with the revised date for filing the Claimant’s Reply to be determined at the CMC.
AND UPON
reading the relevant material in the case file
AND UPON
reading the First Witness Statement of Tiernan Fitzgibbon dated 13 January 2015 and the exhibit attached thereto
AND UPON
reviewing the letter from the Defendant’s representatives dated 15 January 2015 agreeing to the Claimant’s proposal to file their Reply to Defence after the CMC is concluded
AND HAVING
considered Rule 16.18 of the Rules of the
DIFC Courts
(RDC)
AND PURSUANT
to Rule 36.40 of the Rules of the
DIFC
Courts, paragraph 2 of this Order is amended.
IT IS HEREBY ORDERED THAT:
The Application is dismissed as the Claimant has failed to provide sufficient reasons as to why an extension should be granted pursuant to RDC 16.18.
The Claimant shall file their Reply to Defence by no later than
4pm on Thursday 29 January 2015
