IT IS HEREBY ORDERED THAT:
1. The Defendant's Application to
strike out
the
Claimant
's Claim and Defence without further notice, unless the Claimants provide all the information and documents requested in the Defendant's letter of 22 December 2013, is dismissed.
2. No order as to costs is made for the period from 19 January 2014–31 January 2014.
3. The Defendant shall pay the Claimant's costs, summarily assessed by the Deputy
Chief Justice
Sir John Chadwick, from 1 February 2014 until the end of the hearing which took place on 5 February 2014.
4. The summary assessment of the costs amounts to US$ 8,700, being the full costs of the hearing and 50% of the costs leading up to the hearing.
