UPON
the parties having agreed terms of settlement as set out in an Agreement between the parties dated 4 February 2010 (the "Agreement"), it is ordered by consent:
1. The action under Claim number CFI 003/2008 be dismissed.
2. Liberty to apply for purpose of implementing the terms of the Agreement.
3. The security for costs given by the Claimant be released to the Claimant.
4. There be no further order for costs.
