reading the Claimant’s email dated 29 August 2016, confirming that it shall carry out a reasonable search for documents in its possession, custody or control which are responsive to the Defendant’s Requests 2 and 3 and produce those documents to the Defendant
AND UPON
reading the Defendant’s responses to the Claimant’s Request to Produce, dated 23 August 2016, confirming that it accepts item 4, seeking the production of all monitoring reports (or any other reports) produced by EC Harris for the Defendant, including but not limited to, those in respect of the months May, June, July and November 2014
IT IS HEREBY ORDERED THAT
the Claimant and Defendant’s Requests to Produce are denied pursuant to the grounds for excluding documents from production contained within Rule 28.28 of the Rules of the
DIFC Courts
, except for requests which have been accepted or accepted with a narrower scope by the parties.
