UPON
reading the Application Notice dated 15 July 2010 of the Claimant;
AND UPON
hearing the submissions of counsel for the Claimant and the Defendant;
AND UPON
Judgment on the application being reserved until 11 November 2010;
IT IS ORDERED THAT:
Provision of Information:
1. Standard production of documents is to be made by 28 November 2010;
2. The Defendant's application for the disclosure of specific documents set out in its Case Management Information Sheet shall be adjourned pending the above standard production of documents. That application may be restored by the Claimant following receipt of standard production.
3. Signed statements of witnesses of fact, and hearsay notices where required by CR
29.102
are to be exchanged no later than 9 January 2011;
4. The Defendant will serve any expert report it intends to rely on in relation to the question of damages no later than 23 January 2011;
5. The Claimant will serve any expert report in response no later than 14 February 2011;
6. The pre-trial review date is 16 February 2011. Each party is to lodge a completed progress monitoring information sheet with the
Registry
by no later than 7 February 2011 (with a copy to all other parties);
7. Meeting of experts to be held on or before 28 February 2011;
8. The joint expert memorandum is to be completed by 7 March 2011;
9. The Claimant is to submit to the Defendant a proposal for the trial bundle index not less than 6 weeks before the trial date;
10. The Defendant is to respond to proposals for the trial bundle not less than 4 weeks before the trial date;
11. The trial bundles are to be submitted to the Registry and the Defendant not less than 14 days before the trial date;
12. The Claimant is to submit its skeleton argument not later than 1pm (
UAE
time) two clear days before the start of the trial;
13. The Defendant is to submit its skeleton argument not later than 1pm (UAE time) one clear day before the start of the trial;
14. The trial of this matter will commence on 20 March 2011, with five days reserved for the hearing;
15. Any applications for additional production should be made no later than 14 days before the trial; and
16. Costs reserved.
